Hey, I just noticed, since you guys seem to consider yourselves consumer advocates - where's the links to help consumers (being all of us) going into foreclosure due to bankster fraud? James H, that's the kind of things we all need to know. Pull your moneyout of the big banks, take away their support for their continued fraudulent activies and gambling on your dime. If we all took our money out of the big banks and put them into local banks that use their money to help our own communities, our neighborhoods would all be better off and the banks would be drained dry of funds to gamble with. Drain them dry before they drain us dry. fiat iustitia, pereat mundus (follow the rules, even if the world should perish).

Remember what I said the letters and calls will go now where , all your investors you deal with will insist you follow the new April changes or they will not fund . The only way to change this was for everyone to refuse to write a mortgage after April 1. That is the only way it will work but it seems we are too busy writing useless letters.I know a few Congressmen , your letters are going nowhere . EVERYONE SHOULD THINK ABOUT JOINING National Loan Officers Union and refuse to work on April one on until the law is retracted . Thank you [email protected]

I might be a little too "conspiracy theorist" but the banks don't want to take foreclosures and love the various moratoriums. 2 years ago the banks were given a little gem changing the mark-to-market accounting rules. Now banks only have to take their lumps when the home transfers in a foreclosure to them. Why do you think people have lived for 1-2 years without being foreclosed on? This robo-signing "fiasco" is just what the banks want. Think about it. All the foreclosures that nearly drove us off the financial cliff are insignificant compared to the number of foreclosures backed-up, not acted upon and going through the short sale process. No, this is all a well planned, carefully constructed back-door bailout designed by the Feds to keep the banks solvent for as long as possible. If I die remember this post, the Government assassinated me!

Hi Guys, B of A just sent out a new notice saying they are starting a new program called Cooperative short sale program. Under this program the seller could be liable for a deficiency. They are calling this a fast short sale program over the others. And under the new program they are going to want the seller to sign a promissory note for the deficiency. Yes, there are agents and brokers out there that will advise their clients to go with this program because they are starving themselves. As a broker I would not or could not advise my client to sign a promissory note when because if they just let the bank take the property back they are off the hook for the deficiency. Broker and agents you need to beware of the liability this could cause you if you advise your client to sign such a note to the bank when there is a law that wipes out the deficiency. You as a broker or agent could end up in a court room defending your greedy ass for advising a homeowner in signing this note. DON'T DO IT!

Hi Guys You talked about how send msg's to renters has worked well but most responses say otherwise. Can you send us info on what exactly people are doing to get results?

Frank & Brian: here is an unintended consequence of the broker compensation changes: I received a 1099 from a lender for over TWICE what I received because they included all funds credited to the buyer (block 2) even though they did not pass thru my hands at any point. So far, I've only received 2 1099s and the second lender did not do it this way. I'm curious if anyone else has had this happen?
Clulessdad: (February 01, 2011 9:41am)
NAIHP needs money to file a lawsuit against the FED and the Compensation rule. Everyone should be helping and contributing to fight this illegal fight. Go to www.NAIHP.org and give Marc Savitt your support and a contribution today. $50-100-250 is a small price to pay to keep us going. DO IT TODAY! frank and Brian-it seems like some momentum is being built with NAMB and NAIHP. Can you go and promote them to the viewers?

It's obvious to me that you guys think nothing of the fraud of the banks in making loans to people that they knew could not afford them. They flooded the markets with these bad loans that were made to default and destroyed home values and decimated the worlds financial systems. That is where the crimes are. And it continues with robo-signing all their legal documents to try cover their asses after the facts of their fraudulent assignments. How can you wish this would stop? When someone sells their home, how does anyone know if they have the legal right to sell it because no one has the note? Can the new buyer be assured the home is theirs without proper prior transfer of the note? Do you know the problems that could cause? This country and it's wealth was founded on property rights and if those rights are violated in any way shape or form, where are we? Who owns what?

Who cares about banksters B of A, they're insolvent zombies. Show me the note! There will be no recovery until the banksters are prosecuted for fraud. You guys seem to be getting more and more "poor TBTF's" sympathizers ignoring the problems they've created.

I'm in new home sales and this is a hige market for me! Go figure homeownership costs less than renting. I have had to add credit repair as a cost to do business but no problem. I sold 4 this last weekend!!!!! Writting another one at 11:30. Go Houston market!

I was about to check my sanity on working up a couple of purchase loans for renters when I received this text message from another LO who is a friend but also a tough competitor: “You ever seen loans so hard to work? Pray this isn’t an indication of how the rest of the year will go.” Well, it least it made me feel better.
Mike8307: (February 01, 2011 8:28am)
Have to agree with Kaf.. here in Florida converting renters is tough. One thing overlooked, is that many renters are former owners, with foreclosures and shorts on their credit. This puts them in a 'timeout period' of 3 years.
kafprocessing: (February 01, 2011 7:55am)
Getting people to consider buying in Florida is a VERY hard sell. 12% unemployment, house prices continue to fall, brutal lender requirements and the daily pounding of bad news. One segment which will be the prime buyers in the next few years are those who did own but now rent. It is correct you can no longer talk about equity appreciation without being laughed at and the costs and overall uncertainty keeps people on the sidelines. However, and I know this is anecdotal, I have talked to folks who had foreclosure and BK in 2008 and now are back up to 670 credit. I imagine those with just a short sale or deed-in-lieu will recover even faster. My point is once someone has owned a home, no matter the experience, most will NEVER feel good renting. Here in South Florida, rents are going through the roof because many apartments were converted to condos during the boom. I believe the former owners will be back. Maybe not this year, but they wil be back.

Go to www.naihp.com website, go to call to action and ACT. I think it is pretty amazing the Egyptians in American hit the streets to protest about what is going on in Egypt and we Loan Originators and Appraisers cannot organize ourselves to react to what can only be unconstitutional price fixing! Tens of Thousands originators need to be following this link AND the NAMB link mentioned below! Can you say "I'm tired of it and I'm not going to take it any more"?

My guys in Alabama have already been contacted, I have even heard back from them....hopefully we can kill this, before it decimates our earning potential.

Frank & Brian, the letter link isn't working. Are you able to fix this? Thank you for sharing!
Owl Tree: (February 01, 2011 6:49am)
800Fico....thanks for spreading the word. I contacted my congressman and both senators, and also contacted the Federal Reserve to advise them to delay the rule until it was properly consumer-tested. Everyone who originates loans needs to make themselves heard on this issue.
DanSchweihs: (February 01, 2011 6:24am)
Stated another way, BofA is acting very rationally. See my comment below.
DanSchweihs: (February 01, 2011 6:19am)
Filing false affidavits in court is a crime. Doing it once is a mistake but over and over again indicates intent, which makes it a crime. If BofA’s agent does this for them with BofAs knowledge, BofA is a co-conspirators in the commission of a crime. If a broker did this, they would be put in jail. The too-big-to-fail banks are too-big-to-fail and are politely told to try to refile accurate documents after they are caught committing perjury and fraud. It appears that the judge is apologizing to BofA for inconveniencing them. The whole system would get fixed if one BofA employee spent one night in jail. The other BofA employees would start to behave and take their customer's rights seriously. Until then, expect more of the same. If my dog pees in the house and there are no consequences, she will do it again.
Ezradams: (February 01, 2011 6:16am)
doitright is correct. In the past, the best hook was that the purchase of a property came with the potential for appreciation and a positive equity position....not in the cards at the present time. Cost to maintain and possible loss of equity is on everyone's mind. Oh, and how about all the crap required to get a mortgage? Buying is a tough sell!
doitright: (February 01, 2011 5:09am)
Just a bear when it comes to housing so here it comes . Marketing 101 you can not create need . That is the bottom line situational problem right now , there is no need for buying a home . Now you give renters 8,000 in tax credits that created a sale but the true need was the 8,000 not the house or shelter . There is no need to own a home , the amount of repairs , upkeep , payments , taxes , insurance it is way too high for waht you get . So what we will have in the next two years will be a fix in price based on demand . Demand is created by a need , and again show me the need to buy a home that is a depreciating asset? By the way if someone sent me an ad via my phone I would never ever shop there . More like a moble junk mail pain in the neck . Do you truly think this is great? Thanks
Divedude: (February 01, 2011 3:55am)
BOA should have added, "Please excuse our total lack of control and ability to run our company in a professional and ethical manner." While we are aware that we have detroyed the lives of millions, we are working dilgently to sweep this under the carpet.
