ssfranny - nice, ripping someone for being negative, then immediately denegrating an entire profession in the next few line. I'd like any agent that might have been thinking about referring business to you to see THAT post. i'd like to know how many loans you've originated and been paid for that have gone belly up. ? all i can say is i'm gad you don't sell used cars
5pence: (February 12, 2011 11:15am)
Ahh but ssfranny, realtors have something going for them that guarantees ridiculous commissions - they're a Guild. They have a Guild, we don't - they must be smarter than us. They're certainly paid better than us.
ssfranny: (February 12, 2011 11:12am)
Doitright: you know someone should print off all your negative comments and show it to your clients I bet they run from you like the plague. Why would the bank give a crap that someone is picking fruit so it doesnt rot on the property?? Now if that person was selling it for p Also, if one realtor goes on the property to pick the friut how is it "trespassing"? Most if not all foreclosed homes/short sales are listed by a broker. As long as the realtor is not climbing a tree to do it who cares? Wow no wonder this housing/real estate industry had been in the dumps negative people like "doitright". I thought at one point getting my RE license but he reminded me why I loathe most realtors. Make a 6% commission for sticking a sign in someones yard and acting like they're doing something important. If I ever get my RE license I'll undercut every idiot realtor in town and do the same thing they do for less. No wonder people look at realtors with less respect than car salesman.

Great Idea about the Fruit. I don't think people will like the Fruit from the SF Bay area though.. it might have issues :-). In Texas you start rummaging around a vacant property you need to get in touch with the Law enforcement and let them know what you are doing and they probably will be ok with it.
doitright: (February 12, 2011 6:54am)
@scottD name one underwriter at any investor that is not going to require a letter of intent on the prior home vs the new home so that they can provide a little proof that they will move into the new property as an owner occupied? It is a Fannie Freddie FHA VA requirement and has been stressed in numerous overlay memos. I am sure you have never pulled one of these off and if you have you should get out of this business. You are the slum that gave the industry a bad name in the past. Don’t forget you promised me national attention on this in three months, maybe we can speed that up and let the FBI know what you are up to. It is called fraudulent collusion and involves investments (mortgages) so it is a felony. Now back to the lemon picker I am just wondering if this is even true, how the hell do you eat lemons for lunch or dinner? Have you ever had a plate of lemons? How does this feed them? More like “I will take a squirt of that in my iced tea". I think Mrs. Ed Bagley Jr is possibly full of it, feeding families on lemons? Now go make some lemonade
sue806: (February 12, 2011 12:16am)
Every one of us know what is happening is not right, and we always had the opportunity to "correct" it. There is no reason why the taxpayers should pay for the mistakes of Wall Street greed. There is alot of talk about small segments of the industry uniting but I am talking about getting your friends and neighbors involved. If every one of us sent the website Unitedinprosperity.org to our "email" list there would be immediate changes because it would no longer be a small segment of the population but a large segment of the voting population.
sue806: (February 11, 2011 11:58pm)
Outside of the box, lets work in the box,. every negative equity homeowner is legally entitled to a similar financial "benefit" to remain a negative equity homeowner as the 25% of negative equity homeowners who were already modified. Go to Unitedinprosperity.org to join the petition saving your industry (real estate and mortgage brokers and appraisers) from having no voice.

It's a real problem nowadays, people just don't trust each other and that's really sad because it divides us. People hide behind their prejudices and biases of right and wrong, Dem or Repub, etc, etc etc.. instead of embracing and seeing that the trust that could be won is mankinds noblest venture.
5pence: (February 11, 2011 6:47pm)
It really comes down to a matter of trust, if trust was won then the risk was worth it.

Brian & Frank, Our office already thinks outside of the box. We do not have the fruit trees to pick from but we do volunteer at our local Habitat for Humanity to help rebuild the homes that were destroyed in the May floods in middle Tennessee. It is a WIN WIN situation for everyone.
Arkad: (February 11, 2011 3:48pm)
I am not saying it’s wrong because of getting caught, sued, arrested or ripping your clothes. It’s wrong because... it’s wrong. Justifying stealing property by calling it “abandoned”... or abandoned using all caps as SHAWNEE did, is laughable. Anyone that has spent time in the missions field in 3rd world countries, or the 2/3 world as it is now trendy to call it, will tell you can’t turn you back on anything or walk away from anything for even 30 seconds or it will be gone... because you abandoned it. as soon as we justify stealing of any kind for any reason, what is to stop the process from continuing. This is a bad idea because it’s wrong... my 4 year old knows better.
DeniseWhite: (February 11, 2011 3:47pm)
Hey, folks. The point is thinking outside of the box for marketing. It's not about the legalities of picking fruit on REO properties. How about sharing a better idea instead of tearing apart this one? I'd love to hear some new ideas.
Gmoney: (February 11, 2011 3:14pm)
Let me know when one of those people need a loan. Good idea if you get some pub out of the deal. Otherwise it is a great way to feel good.
Scott D: (February 11, 2011 3:11pm)
iam 2520 you're getting close buddy. Unethical perhaps. Spirit of fraud. No way not even close. The 20-30% down on the new home is definitely part of this equation. Equity in the old home is never part of the analysis with 780+ scores across the board, post closing DTI < 20% and 60-120 months ALL PROPERTY PITI reserves in the bank. YES there are so many of these prospects out there and none of them want to wait until their equity is recovered by market appreciation in the next 5-10 years. I negotiated a truly remarkable super jumbo transaction last year. Caught the lender making an aggregious FCRA error on their credit report causing that specific mortgages entire history removed form their reports. Just takes a little brains, some extra effort and READ THE DOCUMENTS PEOPLE! Sucess is in the details and sterling perfect clients.
loaner55: (February 11, 2011 3:11pm)
Unfortunately there are too many lawyers in California and for that matter the entire country that would see this as an opportunity for a lawsuit. I'm all for the giving part, but not the getting sued part, and trust me, it will happen. As soon as the Banks get wind of this, they will put it in their contracts because they don'e want to be held liable. Next !
iam 2520: (February 11, 2011 2:53pm)
Besides the trespassing, theft and extreem liability this charitable activity causes or has the potential to snowball into, getting new business is not one of them. Say what you will no REO mgr. in a sane moment would give verbal let alone written approval for this outsie the bushel barrel idea. They may want the rotten fruit swept and picked up to avoid a slip-n-fall from a slimmey lawyer. I did like the neighborhood idea of cleaning up the trash-outs, good neighbors do this by themselves, makes their homes look good and their neighbors trash from blowing around. As to the staging of the video... blame the producers not the actor(s). Yes, I would also agree that if it is not fraud it is the spirit of loan fraud... stratigic default is frought with danger... just try to buy that next home WHILE you still own and are current on the USS Underwater... nothing $$ and more $$ will not help. 35% Provable Equity + 20-30% down on the replacement (second home) plus LOTS of re$erves...
Swarm The Banks: (February 11, 2011 2:38pm)
ATLMTGMAN, Please don't clump every comment into one big negative bin. My clothing comment was not meant in a negative way at all. However, I would like to add that picking fruit is more complicated than you seem to be aware of. Even the way the fruit is picked can harm the tree if not done correctly. Just as you get offended if a homeowner thinks they can sell their home by themselves, fruit pickers who know their craft might take offense to the idea that picking fruit is a no brainer, it actually takes experience and knowledge to pick fruit without damaging either the tree, future harvests, or one's clothes. Those are not reasons to be against the idea, just mentioning it, that's all.
Scott D: (February 11, 2011 2:32pm)
Lefse2409 you are making a lot of assumptions on something you obviously know very little about. No letters of rental intentions, no reason to offset the debt with false income because there is none of that. No fabricating any documents. Just Triple AAA credit grade, highly resourceful borrowers with extrenemly low DTI's 10-15% with both mortgages accounted for. Remember 85% of the country is in fairly good shape and 30% of those are in fantastic shape just pissed off about their property values. Lenders have to approve short sales. Once that document arrives its all about smooth as silk final settlements to avoid a foreclosure blemish on that homeowners credit report. There is abosutley nothing illegal about this. No blowback, no recourse, no retribution. Its a highly intelligent financial maneuveur for those who qualify. There is a lot of rookies on this forum. I've testifed in federal court as an expert witness many times. You should be more thoughtful before you spew accusations.
jhutchings: (February 11, 2011 2:10pm)
Atlmtgman- How is getting arrested, possible lawsuits, and sued, leading to our losing our license and ending up in the same situation as those of the people we are trying to help going to help anything. I'm all for helping others, I just think there are better ways. I still say kudos to her for thinking outside the box. If it works for her great. I hope she ends up being OK.
ATLMTGMAN: (February 11, 2011 1:41pm)
I don't believe this load of crap from all you knuckleheads. You're worried about getting arrested, getting sued, ripping clothes, not benfiting from it and other stupidity when you have been show a simple way to help fellow human beings. No wonder the whole damned country hates us and we can't get together as a group. You are just a bunch self serving hateful money grubbing, self loating, fearful idiots and you desreve everything the fed dishes out to you. It's not about you, or what you can get out of it, it's about HELPING PEOPLE and if you're lucky, mayme get some recognition for being a good person. People prefer to do business with "good" people. I wish I lived in an area with that kind of wasted abudance, I would be climing fences to get at the fruit and if I was to be arrested or sued, I would turn a negative into a positive and let it be sorted out in the media.
Lefse2409: (February 11, 2011 1:35pm)
I think it was implied that she was doing this for her listings and not trespassing on other's property. @Swarm The Banks - I am pretty sure she would wear appropriate clothing when picking fruit, and not business formal attire. She probably does it on a weekend or something. @ScottD - that is, without question, mortgage fraud. You have an advanced knowledge of the act and have discussed it with the client prior to them committing it. You, the title company, the other agents involved, and anyone else involved in both of those transactions who had knowledge of this (the purchase and the default) are culpable. Plus you have broadcasted it on an internet forum. You will lose that argument, regardless of how skilled your counsel is. Don't do it. It is the new lender who has been defrauded, and anyone in that transaction is fair game for prosecution. They issued a new loan based on documents and a letter of explanation stating they are going to sell, retain or rent the old property. Fraud.

5spence- Thanks for the shout out!
danheilbrun: (February 11, 2011 1:25pm)
Keep in mind that encouraging some one to commit an illegal act is solicitation. Trespass does not exist with consent and Bonnie is getting consent, therefore no trespass, no solicitation. I guess the legal question is who is able to give consent? But outside of the marketing gambit, isnt this just doing the right thing? Also, you cant sue someone who is giving something to someone they would not otherwise purchase, ie damages. Intentional interference in contracts have to be done maliciously. This suit would fail. Besides, you arent making money on it. As petty as this world may seem, there is still a good spirit associated with it, and good oftentimes prevails, even in our litigious society.
acwheelin: (February 11, 2011 1:08pm)
TBWS – I love the idea about thinking outside the box. Especially because fresh produce isn’t as plentiful in the food shelters. However, my initial thought was – someone will sue (probably the ACLU because she’s taking jobs from farm laborers). If she is getting permission to do this then I think that was an important point to make – otherwise it is technically trespassing and stealing. We are such a petty, litigious society these days that you have to do CYA on everything! (Hence all the forms and stuff we have to complete for mortgages!)
acwheelin: (February 11, 2011 1:07pm)
Joe_DAgostino – think outside of your own box in your area. Of course we don’t have fruit trees in Philly. Do you remember 11-year-old Trevor who in 1983 saw a newscast about homeless people? He begged his parents to take him to town “that night” so he could give someone his own blanket and pillow. It’s now 2011 and Trevor’s Campaign is still going strong.
acwheelin: (February 11, 2011 1:06pm)
DoitRight – You’ve made your point about getting permission now move on. Brian said she had permission so there’s no need to continue to rain on someone’s parade. Go sell another house – with or without fruit.

Descibes the banks perfectly NOW when they value their foreclosures with realtor BPO's where the realtors eventually end up with the listing, and where skippy appraisers are hired by AMC's to value property per their guidelines where it always comes out low. Or HUD telling the countries appraisers that certain areas are "declining value" market areas and then the amc FORCES the appraiser to lower values when it usually isn't necessary and harms property values for miles around. Or, the banks foreclosing when they could effect a sale and get all their money. "This country is glutteness.... and inevitably will step over dollars to pick up dimes."

Swarm The Banks: (February 11, 2011 12:29pm)
common sense, thanks for the response, and 8 trillion dollars in lost equity, are you kidding me??? Even if half was lost because of lowered home values, can we assume that the other 4 trillion dollars was diverted from homeowners by foreclosing on them without allowing them fair access to some of that home equity? The fruit idea is a great idea, but it does have some other gotcha's that have not been mentioned, such as, unpruned fruit trees still produce a ton of fruit, just don't go dressed too well when you pick that fruit, or you'll quickly discovered the wrath of the dead, think branches as they scratch you, and your clothes up for snatching their fruit. 20 dollars of fruit picked, a 200 dollar suit ripped, priceless.

Is there such a thing as laws of common sense? humanity? charity? community? In no other place on this planet would perfectly good and nutritious food be left to lay to waste when so many people have to go without! Only in America! Dont forget these properties have been ABANDONED by the homeowners and the BANKS! Thanks you guys for sharing this Realtors good deed.

I can’t believe all these people are bring this idea down. Obviously it’s okay to steal from someone if they don’t know you are stealing from them. Clearly it’s okay to steal if they don’t want what you are stealing. We can all agree stealing is okay if you are going to help people with what you stole. It is impossible to say, but the food is probably okay for others to eat. AND best of all there is nothing wrong with encouraging others to participate in illegal activity that opens them up to liability. But to be fair... I missed how this idea generates business for me. I am all about doing charity work... but let’s not pretend this is MARKETING.

Scott D: (February 11, 2011 10:37am)
There’s big money in the gray area right now. That’s the point of this concept and it does take expanding horizons. All of these target victims are still living in their homes. Up to 5,000 new ones each month in this loan balance target. 1000 of them are considering strategic default and still are paying on time on their current mortgages. I’ve already consummated a dozen of these clients in the last 12 months. They buy a lower priced home $350,000 (same or more square feet good neighborhoods) and walk away from their $500,000 previous mortgage. This causes a new purchase mortgage loan origination, a short sale listing referral to a real estate agent and a buyer’s agent bringing a new buyer to buy the short sale transaction with another new purchase mortgage. The other 4000 are struggling unsuccessfully with a loan mod in process that simply needs professional assistance or hand holding transition into a short sale, lease purchase contract or deed-in-lieu negotiation.

Scott D: (February 11, 2011 9:55am)
It’s going to be some work and minor financial costs but there is no way that it won’t cause revenue streams across multiple avenues. I see generating leads for these transactions types: New Purchase Mortgages, Pre-Strategic Default Mortgage Loans, Short Sale Listing contracts with Sales and Purchase contracts for real estate agents, Lease Purchase contracts, Loan Modifications, Third Party Short Sale Processing leads, Closing service for closing attorneys, Default Judgment Buy outs and waivers and boo koo credit repair clients. How does somebody monetize this? Is referral reciprocity adequate? Of course I'll pick the "low-hanging" fruit for myself but what about the rest?
Scott D: (February 11, 2011 9:53am)
Yes dudley-doitright I do think highly of myself because if I don’t nobody else will. It’s not about national attention it’s that I believe that this concept is that strong. Referral Reciprocity Galore Business Plan: “Profiting off the AGONY lead”! Foreclosure victim meet-ups: I’m thinking of targeting $500,000 and up loan balances homeowners, short sales and new mortgage loan amounts. This dollar target is homeowners that have both financial and strategic default hardships and thoughts but they still have reasonably significant resources. This reduces that “people looking for solutions” market size to probably 5,000 to 10,000. Reserve an upscale bar-restaurant in advance then viral market this on the internet in 25-50 local and national blogging and social web sites. Objective is 12 attending the 1st meeting, 25 the next, 50 the next and then 100 with the media mini cams filming the progress of the affair. Then fan out metro wide into 6-12 new locations

Guys, I'm not trying to throw gasoline on the fire, and I could be wrong, but I think she implied that she is only doing this on properties that she is representing as the listing agent. That means she already has an open dialogue with the REO manager at the bank. That is the impression I got. She is listing the property, she has done this in the past with other listings, so she gets permission from the bank before she does it. If they say no, then no harm no foul. I never once got the impression that she is driving around, casing neighborhoods, looking for vacant homes with fruit trees so she can swipe all the fruit with teams of illegal immigrants dangling on rickety & teetering ladders. I am all for bashing the Fed, bashing Congress, and taking this whole Federal Reserve ruling down through class action lawsuits based on anti-trust and FTC rules against collusion and unfair trade advantage, but let's cut the lady some slack here. Just my $0.01 (due to the recession).

There are too many legal ramification when you put food into an equation, especially when dealing with people who really might be needing a buck right now. Best I would suggest is giving knowledge, but it's got to be knowledge that they can't get on their own. I think I disagree with the notion that people don't trust us. For every one person, that I run into, that doesn't, about 4 other's do and know they could hurt themselves if they don't use a professional. I've learned, just don't be pushy, be available, and answer your phone. If you show a client that you're using due diligence to look out for their best interest, they will refer you, and you will feel better at the end of the day knowing your help was appreciated.
GetReal: (February 11, 2011 9:09am)
Realtors and mortgage brokers bear tremendous responsibility for the mortgage mess. Realtors allowed their buyer clients to obtain toxic loans from mortgage brokers who falsified incomes. I know realtors and mortgage brokers who did this, and I actually saw it happening on a reality TV show! The buyer had her realtor on her left side, and the mortgage broker on the right side. The buyer had NO FRIENDS in that room, as both licensed professionals were steering her into a toxic loan so they could get their commission checks. Foreclosed buyers should sue their buyer's agent on their E&O insurance for not advising them about appropriate financing for their situation. (DON'T EVEN THINK ABOUT ARGUING ABOUT "ACCOUNTING ADVICE"! Real estate financing is not about accounting. It's about the licensed professional advising their client about addition and subtraction.) Mortgage brokers that falsified docs should be in jail for loan fraud.

Have company t-shirts made up and participate in walk-a-thons, cancer society drives, heart association drives, it's not limited to picking fruit...all we have here is soy beans, pine trees and cotton. The peach farmers donate what they can after they sell the rest. All of you who poopooed this idea were microscreening the idea. Shame on you.

WOW!lots of school of thought on this topic, now isn't that the point, to get us all thinking? Whether or not you agree or disagree everyone has an opinion. Here something, how about sponsoring a day at the local landfill so that homeowners can clean up there own property. There are so many ways to help our communities and in turn our country that we need to STOP seeing why it wouldn't work and start coming up with ideas for our own local communities.

All I can say is "Wow". I can't believe all the negative rhetoric in response to this woman's idea. Yes, it may be illegal to trespass, but clearly nobody has sought to call the cops on her. And she is clearly not stealing from the "rich", as the "poor" people who owned this property previously would attest. She is doing two positive things: keeping the property a bit more appealing by picking up the dropped (is she?) or ripe fruit, plus providing fruit to needy people and distribution centers. On top of that, she is MARKETING herself. NAR and DRE-MLS groups may have "big" programs that garner a lot of media attention when they happen, but this woman's efforts are the "grass roots" personal efforts that make more of a difference in peoples lives. No, I'm not a soft-hearted liberal. Do you know the root definition of Conservative? "to conserve". I say wow, she is thinking outside the box.

"doitright" you're hilarious, closed minded and not very creative. And you don’t know me. It doesn't get more eye to eye or face to face than this idea. Within 10 miles of my office there are 100,000 people looking for solutions right now. I'm gonna go blow some chunks with this idea for the next 6 months and predict I'll have loan officers, real estate agents and closing attorneys kissing my ring for dozens of pre-qualified referrals every month. Its so sad to see that Bonnie's good intentions, have been overshadowed by the threat of legal ramifications of doing something that is morally correct....I fear for us all...we should be ashamed that we are afraid to do what is right rather than what is PC.

Good one. Some posters are crying about free fruit. Some people just don't understand that the law is meant for the good of the greater community, or it's not good law. Americas constitution is based on Indian law anyways. If the fruit is all that is being taken from these lender repossessed lots, that's nothing of significance. Up your game and start moving some materials out of those homes, before the next guy does. JK, but seriously - that's what's happening out there with abandoned homes. Lenders before families? Free fruit haters can let the homeless live with them.

IF it's allowed, IF your not trespassing, IF it's not too much trouble for you, you better have a pocket full of cards. The neighborhood just might appreciate the attention you are giving to a potential eye sore, just another way to expose yourself to new people.

Hey tralrdr why are so angry? Seems that your house must be one of the previous owners of the vacant homes that they are picking the fruit from the trees. Obviously you need an attitude change and need to cancel your membership to TBWS immediately. I hope you post your ignorant comments in your real estate blog about this woman trying to give back to her community, that was inspired by a family member or friend who passed, by helping the food banks and homeless shelters. I sincerly believe you are the true definition of an A hole! Good luck going bankrupt in real estate because I believe in karma and your attitude pathetic. TBWS thank you for sharing one way someone in RE is thinking outside the box.

Poll results: At the time of this post the TBWS poll is showing 62% NO, I won’t do something like this in my area. I believe the TBWS guys are true visionaries. This WOW video has made me think OUTSIDE THE BOX which is the whole intent of the fruit picker video. Triggering synapses firing off into a virtual referral fountain. IDEA: Set up a “meet-up” networking meeting in my area inviting the entire metro Atlanta area to come and discuss (whine) about foreclosures they’ve experienced, cry about lost pets, challenges with failed loan mods, more aggressive strategies that have worked for others and how we going to clean up these neighborhoods that our local sheriff’s office is causing by their indifference to the increase in crime that they are responsible for. This could be a referral fountain spewing leads for loan mods, short sale processing, listing referrals, and mortgage loan referrals from their circles of influence and buyers with CASH INCOME with destroyed credit. OT : Looking at Egypt and what they're doing it occurred to me the reason it's working is because they've shut down the economy. That's why they're not getting shot and why the government is bending and breaking to the protesters will. And NAR and local RE associations DO give to the local communities if you don't know this then YOU are really out of the loop! I think its time to cancel this feed as you guys are just way too much waste of time anymore. This chick is giving Realtors a BAD name by doing this! Another great idea would be to sponsor a Blood Drive in your office/church. Put up signs on the street and let all your clients, friends and family know. Blood is life-saving! I donate and/or recruit for regular blood drives and I make sure my database knows when and where they can donate too. Giving service to the community makes you feel good and improves your image, but if you can also get your clients to join the effort... that is world changing.

I am for charity when is it behind th scenes dont get me wrong. But I want to see a show on how to turn the real estate market around , picking fruit or any charity work will not do it .I am certainly not going to brag about helping people . ***Off-Topic-Post*** You hit some nerves with this WOW video TBWS guys. Everybody’s got their own opinion and it’s great that so many are expressing them. My first encounter with TBWS was that outstanding IndyMac-One West video expose last Feb 2010. I’m happy to announce that I successfully negotiated a permanent mod for a client with that scoundrel servicer. One West contractually agreed to reduce a $5071 PITI down to $2261 PITI with a total life of loan APR of 2.93%. This represents a $2809.80 per month reduction (57%) for my client and needless to say they love me. I ripped their friggin throats out with a barrage of regulatory allegations and complaints. 6 months after your video a perm mod shows up in my client’s mailbox.

Pie-in-the-sky marketing. Stop and think about the liability incurred by potentially sickening someone with worms or bad fruit. We live in a very litigious world. Think of better ways to give back.

This is a great idea, however, as REALTORs, we cannot do this, as it it technically theft. Unless we have the owners' permission, this is totally against the Code of Ethics, not to mention illegal.
jennyharlowe: (February 11, 2011 7:26am)
@MortgageBike I agree with the concept of feeding for a day vs a lifetime but can you imagine the reality of homeless people going into the yards of homes which they have no access rights to collect fruit? Hmmmm. I don't think that would work out very well for the realtor, the homeless, the potential homebuyer or neighborhood residents. It is a good thing to help others. Saying you should really be doing this yourself is not always the right move. The intended lesson is giving back helps everyone - it improves the general image of realtors and others in this industry, shines positive light on those helping which can increase business, gives to families in need (which often times includes children) and helps a non-profit organization.

There is an old Chinese Proverb that says, "Give a man a fish and you feed him for a day. Teach a man to fish and you feed him for a lifetime." Perhaps the best way to help someone less fortunate is to teach them how to provide for themselves. I think Bonnie's intentions are noble, however, a better use of her time and resources might be spent going down to the shelter and getting homeless volunteers to pick the fruit and help feed themselves and the others who were not able. The unintended consequences of providing for those less fortunate many times enables a "poor me - feed me" lifestyle. Harnessing those homeless volunteers would encourage their self respect and foster successful behavior. This would be a benefit to the entire community.

It's the same concept of repairing an item on a home before it is yours. You will never get permission to go in and replace a water heater that has been stripped, and we know Fannie Mae or any REO won't replac it, and it is "illegal" for the Buyer to do it, so somehow it mysteriously gets done and everyone is happy. If you ask permission to go on site to replace the water heater, you will be laughed at. Same concept with the fruit. Don't tell anyone that you are doing it, just go do it. Sure, you can't tell the world how awesome you are, but if you believe in carma, then you are doing the right thing. Escpecially in CA, you need to be very careful in a sue happy state/country. No good deed goes un punished.

While this is a nice idea there are several legal issues which is why NAR will never suggest this program. First, this is tresspassing unless you have the sellers permission. Second, it is stealing as fruit even when it is ground fall has a value and can be sold ask any farmer. Third, what happens when a well meaning REALTOR falls off a ladder and is injured can you all say LAW SUIT? Providing us with marketing ideas is great but think before you speak. No I am not being negative Nillie just want to give you a reality check. We live in a very litigious society so please do not go pick fruit or anything else from my REO's.

Yes, sharing the fruit is a great idea, but.... A certain percentage of those foreclosed homes represent families that lived there long enough to nurture those fruit trees from seedlings into fruit bearing trees. Inevitably, at least some of those tree bearing families made significant down payments on their homes, and, had significant home equity built up in their homes. Did you know that an unemployed homeowner can't apply and receive a home equity line of credit, no matter how much they may have, if that homeowner has taken time off of work to care for an ill family member? So, what are the stories behind the fruit of those trees? How many of those homeowners were literally robbed of hundreds of thousands of dollars of home equity and their down payment because they lost their job while caring for an ill family member, and could not use their own HELOC as a fall back? And how many in those homeless shelters will recognize fruit that came from one of their own fruit trees?

So many things you can do if you will just think a bit. Just this pass week, I taught a financial literacy class for a local organization that deals with "at risk" young adults in the inner-city. This was basic budgeting, debt manaement, savings type stuff. Basic to most of us, but most of these people had never even heard of some of the concepts. I have done this for years and enjoy doing it so I'm not here to toot my own horn. But guess what, the Executive Director of the organization contacted me after the class and wants to talk about getting out of his adjustable rate mortgage on his home. We have set an appointment for next week. An easy lead an I was just doing something to help others! It works people, try it!

Get the violins out , come on do me a favor you have commercialized charity work again. Now every time I do something good I will feel like a whore! I loved the quote from " Now this is the person I want listing my house" . You have to be kidding because she picks fruit and then her deep inner reason is so that people think , Oh isn't she so nice , I have to list with her? Nice people don't make buying a home in style . Oh a few months has past , it is time for her to back and pick this months crop since the listing is probably still there bearing fruit and not sold ! Sure charity is a great thing we do after we have worked and done well for the economy , it does not help the economy . Please do not do charity then brag about it , if you do it is not charity it is advertising , now go sell .

I believe all the naysayers are missing the point here. This woman is doing something positive and so many people are only seeing the negative. The point is to think outside the box and do something that is not just about you! I think fruit is the perfect analogy here. We all want our business to bear fruit, but the question is what kind of seed are you sowing to obtain the fruit you desire? Doing good things for others has a way of always coming back to you. It's a law that is as sure as gravity. Whatever we sow in life we will reap and if we can just take some time to think about others rather than ourselves, we will be the better for it. So you don't want to pick fruit? Well let your creative juice flow and begin to think of ways you and your office can help others in your community. There are literally hundreds of volunteer opportunities in your communities, so pick a couple and bless someone else. You will be the better for it and so will your community.
Scott D: (February 11, 2011 4:51am)
A better idea! Try this on for size, how about organizing “trash offs”. Lenders and Sheriffs Offices post foreclosure will “trash-out” a home before listing it most of the time leaving huge piles of refuse and garbage in the drive ways. In my state and county there is no blow back from authorities for this bank REO malfeasance. If you have a listing in the neighborhood that has this type of institutional caused blight and are working with a specific mortgage lender to do your pre-qualification letters and originations get everyone together to clean up the entire neighborhood that you’re client is in. Place a flyer on all the neighbor’s homes front doors that you just cleaned up their neighborhood for free. DO THIS RIGHT and DO IT LOUD! This will generate good will in the entire neighborhood for both the loan officer and real estate agent, this will easily attract public relations articles posted in local newspapers and on television. Watch your business and referrals explode. DO IT!
Scott D: (February 11, 2011 4:47am)
This video is very disappointing. I commend you guys for the daily video promotions but in this case you’ve delivered a brain f**t. You guys nail it 90% of the time and nobody can expect better than that. They say that California is the land of fruits and nuts. This video proves that. With 98% of vacant foreclosed homes with no fruit trees. Realtors thinking they can pick fruit from properties that they don’t own with all of the local, state and federal regulations prohibiting this type of activity. BAD IDEA! Do it if makes you feel good but if you think this will generate any new business for the time and hours put forth you are a fool. See my next post for a better idea.

Thank you @ jplapf you better believe I am right that is how I got my name! I do try to do everything right , sometimes it actually happens that way. Actually when did our business go from selling Real Estate to picking fruit ? I would love to know the name of the banks that are allowing people to get up on ladders on property that already is in the hole? What a law suit that would be . I can not think of one office manager I know that would recommend this . If they do recommend fruit picking they will have the agent that has not sold anything in a year fall off a ladder and sue both the Real Estate company for suggesting this practice , then the bank that has the property and lets get a real good attorney and then sue TBWS for making it a marketing recommendation. How ridiculous is this show getting ? Like picking fruit is going to help create demand for housing ? We all know what happened to the pie baking Realtors, they are gone , and soon the fruit pickers will follow . Come on guys give us some substance so that we don't make this spam ! Make some change , make housing a cool thing to buy again , help entice young couples to want to buy rather then rent

Unfortunately doitright is correct. Liability remain the reality of realty. If you are going to go forward with this idea make sure you have the property owner's written approval. @jlaun 100% agree in the USA we are stifled by government wanting a piece of the pie. You are so so right about the the food permit . When I travel abroad I see so many people selling food at great prices . Good hard working people . One day I asked a friend why are there so many people on the street selling food? He said simple, we don't have hand outs like the USA so people work , but the main reason is we also do not have all the permits, license fees here like in the USA , someone can start a business and work in one day . It is easier in the USA to get unemployment then to hassle with the local , state and federal government reulatiomns and fees . I know you will all say OH look at those other places, well as a well traveled man I have . They are light years ahead of us . Too much regulation does just that it regulates our economy. Politicians are like mobsters all wanting a pinch of our hard earned money, instead of guns they use laws and regulations .
jlaun: (February 11, 2011 3:34am)
I would love to do this but I can already see issues. We have a family in our area that thought it would be nice to feed the homeless, rather than give them money that they might use on booze or cigarettes. When they cooked a meal they made extra and would bring it to the panhandlers. This family thought it also would be a good lesson for their kids. Well they were arrested for serving food without a license. I can just see the agent picking the fruit getting arrested for the same thing.

Stay off the property it is private property , do you have insurance to pick fruit land that is not yours? Be careful those houses are owned by the bank and they will not want law suits if someone falls especially if that person is a Realtor and and not a professional fruit picker. I have have to say if it gets down to who picks fruit for who I list my home with well that is advertising and telling the public how bad it is out there. The best charity goes unknown , I see this as fake, she is bragging about it , and using it to try and find some sad saps to list. I want my Relator selling , being honest and getting my deal done.If he or she is in a tree fruit picking then they can not take the call about a showing . Sorry do charity for sure , but dont brag about it to get business that is sad .

Thinking outside the box is so true, and it is a fantastic way of making sure that you have a way of becoming a tender setter. Remembering your clients is a fantastic way of becoming a outside of the box thinker! I love that idea of bagging the fruit and doing something good people who need it. Being able to realize that people are inherently good people we need to do something that is going to help people realize we are good people, (well some of us) :) You guys have given me so much to think about since I started watching you that I have increased my sales by over 75% from just the last 2 yrs do to just paying attention to what you are letting us know, and simply reminding us as realtors to go back to the basics, and remember people need and want help, am I going to be the positive source of information that they need or am I going to look at them with nothing but $$ for eyes. Thank you guys again for the good info. M
