SSFranny, The application is only after you acquire key items to include income information, property information. We have expanded the 6 items to 9. We have added property type and occupancy, and something else. It is weekend and only going by memory and I don't want to think that hard but thought I would share this with you.

Just saw 2 loan "worksheets" that BofA and Wells are sending out. They say its NOT a GFE or TIL and its not a offer to lock rate or offer for a loan. BofA sends out the GFE after the loan application is taken?
SO my question is won't these lenders have enough information to take a loan like name address, phone number, and SS # to pull credit? I thought once you take an app you have to give them a GFE not some "worksheet"

According to the article the failure rate of loans is increasing exponentially since the pre-dominant use of AMC's. I hope they lose every cent they made using amc's. Unfortunately it's the taxpayers that will be held liable for their negligence and abuse of the system. But, this is perfect - loan failures are increasing due to the use of AMC's and their $150 appraisers. I really don't think that there's any other reason - do you? I don't care if no one is here, it's hilarious imo! You get what you pay for and if you try to cut corners the first time, the 2nd time it could cost you double, which is what's happening Bwahahahahaaah !! HaHAHA-hilarious! March 5 (Bloomberg) - Fannie Mae and Freddie Mac may force lenders including Bank of America Corp., JPMorgan Chase & Co., Wells Fargo & Co. and Citigroup Inc. to buy back $21 billion of home loans this year as part of a crackdown on faulty mortgages. That’s the estimate of Oppenheimer & Co. analyst Chris Kotowski, who says U.S. banks could suffer losses of $7 billion this year when those loans are returned and get marked down to their true value. The GSE's, both controlled by the U.S. government, stuck the 4 biggest U.S. banks with losses of about $5 billion on buybacks in 2009, according to company filings made in the past two weeks. The surge shows lenders are still paying the price for lax standards three years after mortgage markets collapsed under record defaults. The GSE's are looking for more faulty loans to return after suffering $202 billion of losses since 2007, and banks may have to go along, HOW'S THOSE FRAUDULENT AMC'S WORKING OUT FOR YOU ARSEHOLES?!! HA!

sus girl : it seems that unless you have a buyer that's an appraiser you're not going to see too many appraisers that have the HUD-1's. Call your recent homwowner sales and see if the borrower will let you have a copy as you're having problems with the AMC that contracted you? Or something similar? I'd do it, but I don't work for AMC's. Actually, couldn't you get by with a statement from the homeowner about how much they paid? We already know there's a statistical discrpency, thanks to Dave Biggers, about what appraisers are paid by AMC's and the actual going rates. It might be easier going that route with less supporting HUD-1's to punctuate your point? Just offering suggestions. I wish you all the luck in the world of course ;^)

The borrower has already paid the "Appraiser Fee"...so they would have no reason & probally no call back #...& the LO/Broker has no control/idea of what the "Appraiser Fee" charges are/will be...
This will be additional DATA that we need to get our message/point across to our state/fed Rep's...

It must be the AMC fee vs. HUD-1 fee....NOT appraiser fee vs. HUD-1.

Barney was just on and said that investors shouldn't think that what the GSE's are buying is fully backed by the Gov (our money) like Treasury bonds. He also said the Senate has struck from the bill the portion where brokers have to retain fiduciary liability. It appears this whole consumer protection act is still up in the air. Barney was even talking about a House and Senate meeting to iron things out about Senate changes to the bill. Barney wants brokers to retain liability and have skin in the game. Anybody else getting tired of this veneer they're laying on in thicker and thicker coats of "everything's all right"? There is no recovery if unemployment is still up to 20% ! Cluelessdad: For all you read section 9003 of HR 4173. I read in there they will allow indirect compensation based on the rate or loan terms. Doesn't that mean SRP and YSP? Either make EVERYONE disclose or ban it. I also read that you can do indirect compensation if its for reducing closing costs and its fully disclosed.
NO WONDER THE BANKS ARE FIGHTING IT...they don't want to have to disclose SRP. They think they play to a different set of rules than brokers. Also, if you "securitize" you have to keep 5% reserves. Looks like all the mortgage "bankers" will have to do more than dumping a loan on a warehouse line for a few days to get their "hidden" SRP

Hand out information at each of your assignments (I have a sample - e/mail me & I'll forward it

Start your own Petition of NOW INFORMED BORROWERS..for Fair Pay for the Appraisers...Keep this Borrowers Paid/Your Fee split/AMC data...so we have REAL DATA to report to our State/Fed "Leaders". Wachovia Bank purchased WORLD SAVINGS BANK and I helped create the Nation's #1 Streamlined Short Sale Program, which has been nothing short of extraordinary. It works because they are a "portfolio lender" (Lent their own money). 4 day Short Sale approvals, 6% commissions, $2500 to sellers in possession for move out expenses, 10% to 2nd lenders to buy their cooperation and avoid the 2nd lender from being a wrecking ball.
WAMU (Option Arms), WORLD SAVINGS (Pick a Pay) are two great portfolio lender examples. Can you name 10 others who lent their own money in the SF Bay Area?
Also, Congress will incentivize Short Sales as opposed to REO's/Foreclosures. What impact will this have on buyers, sellers, lenders, closers, etc?

Interesting read on the originators- It specifically excludes SRP from compensation to the lender. This is obvious for the banks, because this is where they make their money. I don't understand why the wholesalers don't take their pricing and differentiate between YSP (Disclosed) and SRP (Undisclosed) SRP can be a flat fee based on the loan amount (OK per 4173). It is a big number and it used to be 1-1.5% of the loan amount. Anyone have any thoughts on this?

Brian, are you saying that from what you heard from David Stevens that we should still hold off on our audits? I already cancelled my audit scheduled for the end of Feb on this news, now it looks like I need to get it lined up again. I am afraid HUD is going to bounce this around and I will either waste money on an audit, or take a chance on waiting to only find out they do want the audit and puts me in a bind trying to meet their new deadline. Just a guess, they won't grant any extensions past April 30.
