Sent a long letter to 3 parties at the Federal Trade Commission. I thought there was no one left to complain to lol. I'll let you know. From their site it looks like sunsetting the HVCC isn't in the Senate bill. It has an attachment, HR 1728 which has that a study is to be done of the HVCC and it's effects on consumers and small business only. HR 1728 started out as sunsetting the HVCC - what happened?! I like the House bill much better - it's the better of 2 evils. Anyway - have a great holiday weekend. Watch out for the pranksters lol

That sounds like extortion RnchoMtgChck. This HVCC is absolutely criminal and the ones behind it are not being punished! It gets me angry when I hear how the consumer is being ripped off for no good reason and there's no one to call that will listen!! There is no protection for the consumer against predatory lending practices like those - or is there? Has anyone tried the Federal Trade Commission for complaints? From their site: The FTC's competition mission is to enforce the rules of the competitive marketplace- the antitrust laws. These laws promote vigorous competition and protect consumers from anticompetitive mergers and business practices The Bureau: seeks out and challenges anticompetitive conduct in the marketplace, including monopolization and agreements between competitors; promotes competition in industries where consumer impact is high, such as health care, real estate, oil & gas, technology, and consumer goods;

I have an FHA transaction, borrower paid 400.00 for appraisal at lender A. Then lender A say i need review appraisal, 400.00 but borrower can't pay so seller pay. They both came in at 200k. Then loan declined at lender A - I come into picture to save the day :) Lender B say "oh we need a full review appraisal". I say "crap". Now 3rd appraisal ordered $470.00, I have to pay now. Landsafe appraiser tells me "oh no this is never going to come in". I spend a day doing my comps to prove value and I PREVAIL, appraisal comes in at 200k "go freakin' figure". Now clear for docs but lender wants CIR 100.00 borrower can pay for stove listed deficient in first appraisal, 3rd appraiser didn't mention - i am fighting - THIS IS HOW OUT OF CONTROL THE APPRAISAL PROCESS IS. $1370.00 IN APPRAISAL FEES... just thought i would share. Just wanted to pitch in my two cents regarding the repercussions of the Fed getting out of the MBS purchases. It's a head fake to entice the private sector to get in the game. Rates could double and the private sector would still remain on the sidelines. Watch for the Fed to get back in the game before the end of the second quarter is my guess.

SO CAL-I have also been a staff appraiser,BUT The banks make the rules as they have the money. If they say that the departments have no contact, then that pretty much is to be taken as gospel(why would they lie?.........yeah right). As an appraiser there is nobody to complain to about anything as the Independent Valuation Protection Institute(grand name isnt it?) hasnt been established yet and therefore the provisions regarding the Institute with regard to HVCC are not effective.Even when it is established,it will probably be as effective as a collander holding flatulence. So, sadly, in effect it doesnt really matter what we think,we are just to take what we are given and to shut up,and in any event, we as appraisers dont have a say in this as we are currently the whipping posts of the industry so no matter what we think, no one is listening to us.(One hand clapping etc.)

not mandes,......but mandates.
Joecolorado: (April 01, 2010 1:23pm)
There is no legislation legel or otherwise which mandes an lender to use an amc. They just weaseled their way into the process as it was less expensive at that point for the banks to use established amcs rather than put out the expense of building a separate set of office workers that augmented the mortgage side of their business but were not the loan production staff.
Joecolorado: (April 01, 2010 1:20pm)
any bank or lender can order an appraisal, providing they comply with HVCC which is to have the appraisal ordering section totally separate from the loan production staff. There is no stipulation in HVCC that requires the use of an amc....NONE.

We never negotiate appraisal fees and generally get excellent service for that reason. She used google maps to make sure the appraisers were in the general area, so I know that's not an issue. I understand Arcadia is pretty posh, so that shouldn't be an issue either. We do loans all over the country and often pay up front when we do not have a relationship. I think we are pretty easy to work for, and don't usually have a problem. My point is, L.A. appraisers need to quit whining if they are not even going to answer the phone when opportunity calls.

I just heard the law firm of Dewey, Cheatem and Howe won a billion dollar lawsuit on behalf of AMC's and appraiser fees will now be mandated at $40 for a 1004 full appraisal! "Dewey, Cheatem & Howe is an international law firm working in the fields of personal injury, product liability, casinos, the mafia, the Non-God-Fearing Democrats, Liberal Terrorists, and are actively involved in the Evil Atheist Conspiracy and various litigation cases." "The Dewey, Cheatem and Howe law firm was founded on April 1, 1887 in London, England. The first partners were Howie Dewey, Icabod Cheatham, and Rebecca Howe, who met while attending The City Law School, which they subsequently sued for their poor grades, low graduation rankings and inability to pass the bar.

While Congress is on vacation & won't be re-upping flood insurance, it gives all of us a chance to ponder WHY taxpayers are REPEATEDLY subsidizing the BAILOUTS (literally) of buyers & sellers who own in flood zones with dirt cheap policies (that payout claims again and again and again...) given that no PRIVATE market for flood insurance exists (I wonder why...?). Lets get some Jimmy Stewart from Mr Smith goes to Washington in there. Underneath all of this it's a moral crisis and it's the seats of power in government that have been corrupted beyond retrieval - they've crossed the lines of power and morality for favors of largess and can't turn escape the corruption in their souls that they've created or allowed. Corruption can only grow with the same politicians in power. I personally am sick of it. Look what they've done to this great country. It's a shame. We're now the largest debtor nation in the world and those that bankrupted the world are still in there up to the same tricks that got us here. Now the byword for America is "crime pays". Damn shame

capraisalco- the problem with the homeowner ordering the appraisal is that banks won't accept them because no interested party in the transaction can order the appraisal

I thought your Cali appraisers were hungry. We tried to order an appraisal in the Los Angeles area yesterday and of five appraisers called, only one called us back. We are a bank so there's no AMC to pay. moral of the story? Return your calls and you might just see an increase in your business!

udog - when you vote think term limits and no money to Congress for lobbying. The main thing in my opinion is to wash them all out and start new. Those newly elected will know they do the will of the people or their term will be cut short. Hey, they might even be grateful for being elected - that alone would be a nice change

I'm doing short sale in 20 states right now and the best market trend that I have seen this year is stagnant. All of the other 19 states are still in decline. Of course I'm missing 30 states so i am a little biased. Considering that 1/6 of the us population is in California and the other markets that I work in add up to about 60% of the US population, I would say that we are still in decline. Sorry DSnews. i saw that article too!

Its great to vote them out but who do we vote in????? Most politicians say one thing when they are running for election but once they are in it seems like another person takes the office. A lot of our elected officials have little idea of how the mortgage industry functions. This veterans situation is a primary example of how very little they care. Vacation - there's no vacations is politics.

Hey dudes....that how you guys roll in Cali right?? anyhoo from the bland state of Rhode Island which bye the bye is where some of the best ideas in the country originate...why is it that you guys have not proposed and promoted the most easy and simplest way to circumvent the HVCC that is requiring the homeowner, buyer, etc to be required to order their own appraisal much like they pick lawyers, doctors, plumbers, electricians home inspectors etc. This, in my opinion would solve most if not all of the regs and problems that have arisen with this ill conceived and implemented regulation. Moreover, it would also make the appraisal property of the homeowner thereby make it more portable and would restore the business of home valuation where it belongs with the individual appraisal companies.

I wouldn't be so quick to withdraw the prediction in general. The market tends to have knee jerk reactions and many will wake up this morning and say "Cheese - no more MBS purchases by the fed; wonder what we should do?"
In 2002-2004, mortgage rates usually did not react immediately when the fed changed the discount rate.

First time home buyer and just back from Afganistan can not close on home because it is 1/2 in flood zone. He may lose the house. This is a disgrace to America. He applied before the deadline and the moey for the flood insurance was in escrow.Still since it was not paid for USAA will not let him close. This just goes to show you how much our congress cares about the veterans and the rest of us Americans.Vote em out next time.
