I didn't realize before today's opening scene that you were both Irish Whiskey drinkers. My respect for you now is even higher than it was before; and it was already pretty lofty. Irish Whiskey simply exudes credibility! (Actually, Jamison's 12 year old has got it all over Bush, and even Black Bush. You must try it sometime (tomorrow?).

Mardi Gras Mortgage Broker: (December 30, 2009 10:06am)
Frank and Brian, you guys are the best! All are commenting on 2005 and 2006 with all the changes etc. I am in New Orleans and in August 2005 we were under eight feet of water and in 2006 were still were knee deep in recovery. The events of Hurricane Katrina insulated this market from the aggressive lending practices witnessed in this industry in that time. Nevertheless, my staff and I survived the punishing blows (Katrina, HVCC, testing, finger prints and background checks, etc). I found your website as it was shared by a friend and circulated it among my staff. We are a modest mortgage brokerage of eighty LO's who find inspiration, motivation and insight from your daily. Many have voiced concerns with the new state and fed testing and the new 2010 GFE. I welcome it! I believe, like a natural disaster, this will weed out the weak and dishonest pretenders who were in it for a fast and easy buck and leave in it's wake a stronger, better prepared core of pros. Thanks for all that you do.
Califorlife: (December 30, 2009 10:04am)
wow, I just had a DUH moment. I personally do not have my money in a national bank, but that truly would cripple these crooks running the 5 "too big to fail" institutions -- it's a way for american's to be heard for a change. MOVE YOUR MONEY FOLKS and pass it on to everyone you know. Support your local small business, because in my neck of the woods, those locals banks and S & L's are keeping the real estate industry alive by lending on raw land, construction loans and take out financing, no to mention some GOOD local business people who need stated income in the spirit that stated income was devised back in the day ... our local branches are giving our builders what they need to stay alive, and they aren't faced with the huge foreclosure rates the way the big boys are. Think "it's a wonderful life"...
Nor Cal Mortgage Broker: (December 30, 2009 10:03am)
Mortgage Brokers have NOTHING to fear from the big retail bankers! For example, Suntrust takes 3-4 months to close a simple refi and even when they are refinancing an existing customer, I can beat their rates by at least .25% any day and I can close a loan in less than 30 days even with HVCC, MDIA, etc. The retail bankers were the rule violators and still are. Did you know that the retail banks (BofA, Wells, Suntrust) all charge a nonrefundable app fee upfront in addition to the appraisal and credit report? So they could never close a loan and still make money screwing their suckers, I mean customers. In CA, that would be illegal for a broker to do unless they have an CA DRE advance fee approval. We need to start hammering our CA legislators to require that the banks and retail bankers have the same requirements as brokers, which will force them to change all over. CA is such a big chunk of the nations economy that if they have to change to keep the biz here, they'll do it.

HAPPY NEW YEAR!!!: (December 30, 2009 9:15am)
OMG!!! Now that was funny. Happy New Year guys!! Thanks for calling me last night Frank. I would have answered but I thought you were a bill collector calling me from some obscure 777 area code. FYI the beginning of your recorded pitch is cut off on the voice mail. Tech issue I'm sure. After a few seconds I recognized your voice. Nice pitch by the way.:-) I'll have my automated caller call you to offer to refinance your loan ;-)
CV Broker: (December 30, 2009 9:09am)
I want you and everyone to know that when I first logged in to TBWS Daily, I was on the ropes, ready to throw in the towel. HVCC had dealt such a blow that recovery seemed unlikely. That day gave me the feeling of not being entirely alone - of being connected in a small way and gave me enough strength to go day by day. I started having my Realtor/Broker husband (the sexiest Realtor - hands down!) watch with me every morning and we gained a little ground against the crushing negativity. Fast forward to the year end, 2009, and we just finished our best collective December in 10 years! No FHA, no net branch, just hard work and belief that we would make it through. Thank you for the support, Frank and Brian, and the whole TBWS community.
V: (December 30, 2009 9:03am)
FRANK AND BRIAN AND THE REST OF THE TBWS CREW, YOU MAKE MY DAY, MAY 2010 BE YOUR YEAR!!! I THOROUGHLY ENJOY THE INFORMATION AND APPRECIATE THE WAY YOU PRESENT IT....ALWAYS A LAUGH

RP: (December 30, 2009 8:55am)
Has anyone heard of talk to allow loan originators to be paid as 1099 employees? I beleive this may be a state by state rule so this may not be an issue everywhere (here in PA it must be W-2). Now that LO's must be individually licensed it seems to make sense that 1099 should be allowed. It is pretty much an analogous situation to the employment status of realtors who are permitted to be paid via 1099.
seattle appraiser: (December 30, 2009 8:47am)
Hey, I'm a 30 year old female appraiser who isn't too bad looking (if I may toot my own horn) and I work with three pretty good looking male appraisers. I think we could clinch Washington State if there was an appraiser category! Just because we have to wear ugly shoes to work and carry silly looking bags and/or fanny packs.....
Over-qualified Appraiser: (December 30, 2009 8:47am)
I can't wait till underwriters and processor have to get licenses. I have been asking for this for the last 2 years since every quality and well qualified underwriter got out of the business leaving untrained processors to step into the positions. These "underwriters" believe that refrigerators and garbage disposals are requirements due to healt and safety. Just because some items are typical does not make them required. Good luck with the test guys.
AMC Question: (December 30, 2009 8:41am)
One of the AMC reps who calls on my office has stated that we (a broker shop) can order our own FHA appraisals through his AMC after 2/15/10. He stated we'll be in compliance with HUD & that the lenders have to accept the appraisal since it was ordered through a 3rd party blind order (as long as the apppraiser who did the report is in good standing w/ the bank, the state, etc). I'd much rather do this since the AMC would be staffed with local appraisers rather than order through the lender's AMC which employs God knows who. Does anybody else have any info about this? Thanks, hope everyone has a great New Year.

The Dude Abides in Tacoma, Will D. [email protected]: (December 30, 2009 8:21am)
Izzy, you are 100% correct in your comments my friend... That is exactly why we have TBWS and hopefully our state and federal brokers assoc.' to stand up and fight. I am an 18+ year veteran in the mortgage ind. up in Wa St. and am happy that we have implemented licensing and testing and con. ed. to root out some of the morons, however, DFI should have been going after the fraudulent culprits long ago. AZ Linda, way to go on passing the nat. test, and thanks for the encouraging words!! We need positive thoughts out there for us also at this time. Let's band together and battle for our mortgage broker industry.... Frank, Brian, do you guys still need a Wa St correspondent? Way to go this year, thanks for the positive upbeat and informative news... Merry Christmas and Happy New Year to you all!!!!!!!!
Appraiser in CA: (December 30, 2009 8:17am)

Frank and Brian - Thanks for a fun / enlightening / educational program this year.
Cheers lads: (December 30, 2009 8:12am)
Well done lads! You have come along way from the old studio a few years ago where just a few of us knuckleheads were calling in and shooting the crap with you guys about giving video marketing a shot. Always brilliant to see something grow into a big success from the ground up. Never lose that sick and demented sense of humor both of you add in everyday...perhaps add in a few more Irish themes hahah. Enjoy a nice bottle of Jameson's tomorrow night! Your Irish Friend Michael. Cheers!

A Appraiser: (December 30, 2009 8:08am)
Thank you, guys!!...You have become a fun part of my business (we all know we can't have enough of that in our industry right now). Watching you is much more fun than reading the Wall Street Journal. Your points of view are much more tied to us here in the trenches. Your efforts are making a difference (not many people, syndications or media sources can say that)!!! Happy New Year!! See you in 2010!!!

Any of you guys do your banking at Wells, B of A, Chase, etc? If you do, shame on you! Get your money OUT of those banks and into a small local bank or a credit union.
Steam in Chicago: (December 30, 2009 7:45am)
Scott: Congratulations for having honesty and integrity. 2005-2007 was so out of control with con men and fraudsters. You were right to have a strong QC dept but every rejected loan simply went down the street and closed. Scott at least you can sleep at night and look your chldren in the face and not be ashamed of how you made money. We had a $300 million dollar Countrywide branch across the hall from our shop raided and closed down by the FBI. That entire staff was up and running at First Mangnus on the following Monday morning. Countrywide buried the story and didn't prosecute a single person because they didn't want the negative press/fallout from such a scandal. How many more branches were like this one? Everyone of those criminals are still in the business, not a single one in jail or were banded from our industry. After what I have seen, white collar crime does pay for some of these people. Alot are gone but alot are still around. It's very sad .
forte shorty: (December 30, 2009 7:35am)
Nice Guys. Fitting end. I bet Frank is your personnel guy who hires your help. Nice gig. Thanks for a great year. and best of luck in 2010.
mortgagelady: (December 30, 2009 7:33am)
well, I think your right, I am curious to see what is going to happen right here in IL, we have to already be fingerprinted at a national fingerprinting co, as well as a state police background check and testing which was around 450. and the banks did not have to take the test which resulted I believe in about a 65% failure rate for the first time, wonder if national is going to make us get background and fingerprint again, as we have had to have here in IL for the last 3.6 years..and also had to have 6 hours of con ed every year...and lavern and shirley you two certainly are not.. to smart for that...
HTMS B'ham: (December 30, 2009 7:16am)
To "iwork4nothing" If you are an "independant contract processor, or a contract underwriter". You will have to be NMLS registered, take the same Safe act 20 hours of CEU classes, take the test, possibly be required to have a state license, or meet other state licensing requirements. For the exact requirement by your state. Contact your local state chartered Mortgage Brokers association, Bankers association, or the State banking authority. Sorry I didn't have better news for you. :(
MortgageBrokerGal: (December 30, 2009 7:12am)
Love the Bushmill's guys! Cheers to you in 2010! It's going to be another bumpy ride!
Scott: (December 30, 2009 7:09am)
A little side note to previuos statement. When we did see fraud a lot of times the rep would come up to me later and be mad because New Century funded the loan that I wouldn't do. I would explain that we are to small of a company to take the risk and sorry. I guess they were to small too.
Nuke 'em 'til they Glow: (December 30, 2009 7:05am)
@ AZ Linda Sad that 30%+ of RMLOs are flunking the the NMLS Test the first time through. I think that says something about the people still in the industry. Imagine doing this 2 or 3 years ago. I bet the failure rate would be like 50% or higher! I hope the come out with something like this for Realtors. From my subjective experience 90% of Realtors can't even read a contract. The other 10% or less are true professionals
Scott: (December 30, 2009 7:00am)
A little end of year story. I was an owner of a wholesale company and on a broker advisory committee for Option One. Well some big Goldman Sach and Bank of America mortgage traders wanted to meet with us to educate themselves on where their big packages of loans come from. This was about 2006. They came to our office with some big wigs at Option One. Well I explained our wholesale operation and explained to them that we kick out about 30% of our loans due to fraud. Reaction "What?!". I said yes we have a good QC person and we catch a lot of fraud. Fake w-2's, paystubs, VOE's and even rent check and bank statements every once in a while. "Well you report it to the FBI, right". "No, I have been told by others that they won't even talk to you unless you have signed docs, an we never let it get that far and we there is so much of it where do I start and I need to spend time actually funding loans too". They just sat there shocked. Thanked us and went back to their bubble.
Nuke 'em 'til they Glow: (December 30, 2009 6:58am)
@ iwork4nothing - Contract Processors and Underwriters will have to be licensed and pass a background check with fingerprints and a credit check. You must also file at least an MU4 AND take the state AND Federal Test. See http://mortgage.nationwidelicensingsystem.or for more info
Nuke 'em 'til they Glow: (December 30, 2009 6:42am)
O gosh drinking on Camera what it the world coming to? I love the NMLS test it should be called the giant weedout of 2010. Slight correction even correspondent guys have to take the test. Only RMLOs as they are called now that work for Federally regulated bank. It assumes that you get CE somewhere.
Appraiser Man: (December 30, 2009 6:40am)
I'm not saying, I'm just saying we probably don't have to look any further than Frank and Brians office for the sexiest individuals in the game. Maybe we can get Frank and Brian behind the screen a couple of new faces reporting in 2010 (maybe we should have a petition for that as well).
iwork4nothing: (December 30, 2009 6:32am)
What about contract processors

Ancient Appraiser : (December 30, 2009 6:14am)
Now that I'm selling real estate appraisers really tick me off ! Excuse me; to clarify that I should say AMC Appraisers. Almost closed a house after the third appraisal and $1,200 to find the lender had to contact the appraiser to change the contract price on his report. Had to go through AMC and was the only condition to close. Due to time required to do such a complicated thing we lost the Lock on the loan so had to wait another three days, which should take us in to 2010! Loan officer lost money; buyer pays higher rate; seller is sitting in an empty house but the AMC's skimmed their $600 out of the deal ! What a country! Best to all the coming New Year !!
DAG: (December 30, 2009 6:14am)
Federal testing is no biggie. The problem I have with it is that a broker license for me was $450 vs $350 and LO license $80 vs $50, so the middle man got paid. 2009 goes down in my book as the year of the middle man. Would be great if we could organize a push in Washington to make ALL LO's be licensed and pass the same tests. I'll guarantee you someone doing a loan at a bank has way less knowledge of what they are getting than from a brokered loan. In the meantime, we have to work with what we have. I just closed a first time home buyer RHS loan in 3 weeks vs 8 weeks on a conventional 80% ltv move up buyer because I ordered the appraisal! Happy New Year to all you brokers and appraisers who've made it through 2009! Let's hope 2010 is a year of common sense.
Chris M.: (December 30, 2009 5:56am)
Thanks Brian & Frank for a great daily video for the biz. You guys & the crew do an excellent job informing us on many aspects (I'm an appraiser in TN). Keep up the great work & looking forward to your 2010 videos. P.S. - make a gag reel with bloopers one day.

Brian and Frank already met the sexiest appraisers when they visited New York, so no need to include appraisers in the contest. Way to go Cornerstone Kathy and Jersey Girl!
Denver Girl: (December 30, 2009 5:52am)
So whatcan we do to level the playing field and require those who work for banks to undergo the same scrutiny? How does making them exempt protect the public? I know it'll be difficult because they have the bucks and the lobbyist. Any thoughts?

The plan is working High license fee's, unreaonable and expensive state exams, limit on broker fee's by govt and end investors, CEd in all states, YSP been trying to get rid of that for years and will! The boys want big mgt company's and big govt! someone already said it take your remaining cash and move on..If they want to get you there going to do it! Bonds, finger prints, credit approval, 1040's, etc etc. It will never end

Welcome the testing. Michigan had to get licensed by 1/1/09 and although business is slow, anyone still in the business had a record year, including myself. All the yahoos are gone only the serious remain. If you are really a good mortgage broker, you won't have any problem passing the test and the licensing fee won't eat up your entire yearly income. It really has turned out to be a very good thing.

On the Federal Testing, I have attended several webinars on this and I do not see any exemptions for Correspondents---we have to take the test, 20 hours of CE etc...please share anyting to the contrary if you would please. Banks are exempt which is wrong and where a lot of the want to be's will flee to to bypass this rule or if they can't pass the test.

Bull doodoo guys. The loan business has been downsized. They picked us appraisers off first, we're toast, stick the fork in us, now time to go to work on the mortgage broke(rs). Not much longer for yield spread premium. Try competing with B of A, Wells, Chase, and US Bank then. Take your savings, if you have any (1-2% of you if that many) and head to central and south america. Good luck fellow chump wads.
