Hi All, Lets all keep in mind that this forum is probably the first one that is being viewed by very important people that not only work in the field of Real Estate, but also in politics. As a fellow appraiser, I can understand the frustration that we appraiser's all feel. But we now have a forum! Thank you Frank and Brian! That being said, Sus socal appraiser brought up a good point. We need to collect real data showing real uspap and HUD violations that HVCC is causing. This is how we win. Approach the issue with documented facts that show legal violations. We are wasting our time otherwise. Think about it. If we sent to Cuomo's office a box of documents containing actual violations of RESPA, HUD, USPAP,etc, this bill would be dead!! Signatures send a message, violations shut things down. Lets get some real facts and shut down HVCC.

Eve, sorry was not I. unfortunately I regard politicians with even more contempt than NY AG's so it was not me at that meeting, however when there is a next meeting please mention it in this string and I will try and get there. I am just getting so jaded with the system that I am starting to lose hope.I will be taking some time off this Christmas so maybe that will help, but we will wait until the new year to see if I want to carry on with this profession.

Thank you JoeColorado and all others who have told the Media about HVCC. Are you the Joe who was at the meeting in our US Congressman's office last summer? If more of us made appointments with our politicos and news Media, perhaps it would help (but don't bring a weapon, even in Colorado).

Can we start to collect documentation on HUD-1/closing forms for the Appriasal Fee & our invoice fee...to show the difference & how much the AMC's are making on each assignment? Will this help us in our cause?

Joe Colorado and other interested appraisers. Sorry for the delay. I did not forget you guys. At this point I can put you in touch with the ATA. Association of Texas Appraisers, President Bobby Crisp and Michael Brunson of the Coalition of Appraisers in Nevada. We are trying to set up a National Group. We have interested appraisers in most of the western states and two groups mentioned above already in place and active at the state level. We are going to help each other. These men are assembling rosters of interested appraisers. I will be helping in California where I can. Here are contacts: Bobby Crisp : [email protected] ..... Michael Brunson: [email protected] The people that are starting this train moving are all quality individuals, moving foreward to form a National Appraiser PAC in order for ALL Appraisers to have a voice in DC and at the state level. Simple and direct.

real appraiser - I don't know who you are or where you are from, but I feel that your ideas and opinions hold a great deal of merit. We really need to come together as one voice, one force for the good of all and set aside our petty differences while adopting and striving for an attitude of maturity and respect as we interact with one another. We are ALL frustrated and angry by what outside forces have imposed on us. However, just because we may feel "safe" to vent with and upon one another, I believe it is FAR more important to take the high road and work together toward more preferable solutions. It is also essential to seriously consider the possibilities, which may be opportunities in diguise. Thank you all for your participation. Thanks, Brian and Frank, for making our forum possible.

I feel we should start a campaign to help this appraiser out. LET'S ALL HELP THIS APPRAISER!!!That would send a message of the support for getting rid of HVCC's. People snap, commit suicide even murder when they lose their jobs for God's sake! That is the way this appraiser is reacting so why is everybody surprised? Not that I condone his actions but some people are just driven to do crazy things when they are forced to give up their livelyhood by crazy people like Cuomo and his ilk.

alright guys. we're leaving these posts in but lets be careful with our words. Nobodys happy with HVCC but lets stay out of the gutter and violence. Little update on a HVCC/AMC fiasco! As I semi-retired appraiser (forced) I am a working Real Estate Broker. One of my agents buyers found "the perfect home" --- easy to value in the neighborhood of $380 to $390. Against our advise the buyers offered $406 on a $429 listing. First appraiser drove 80 miles and came in at $410 (WTF?), after three weeks the lender ordered second appraisal. This appraiser even indicated to the selling agent he didn't want to tick off the lender; so he came in at $375. Buyers now out $800 and no closer to closing after 60 days. Neither appraiser has been certified for much more than one year. Who did HVCC and the AMC's help on this besides the AMC who collected over $400 from their share of the appraisal fees ? To bad the appraiser called first !

Let's get the REAL story out: (December 18, 2009 10:48am)
Appraisers and Brokers: Let's focus on the REAL story - the BIG PICTURE. Cuomo handed control and market share over to the big banks and their subsidiary AMCs when he revised the original verson of the HVCC to let bank owned AMCs operate without restriction! Cuomo revised the Code in their favor - a hypocrisy that should be the focus of the credibility of the HVCC, one that goes directly against original intent of the Code!!! Everyone, please call your local media and get this story out to the public's eye. YES, that means you! We can make it very difficult for the GSEs and Cuomo to continue to support the Code if the facts are exposed!

Brian-How soon can you get more info? Although the NY appraiser was posssibly out of line, we shouldn't let him sit in jail over the holidays just because he allegedly acted on what some or many feel. That is a herd that needs thinning out at fear from the public.

Real Appraiser. I find that an interesting point as well. We did a show on it. Well intended programs for people that otherwise would not qualify for a loan.... is not a good idea. real appraiser: (December 18, 2009 9:31am)
Bad news. Would you agree that barney, cuomo and friends pushed heavily for banks to lend more to those who could not afford home loans, making it easier for banks to act impoperly. You dont need to push banks to be greedy, they are already there, I could care less if they said it was to help minorities, I am one, and anyone who cant afford a loan, should not get one. thats part of the problem

It's the appraisal review companies that are killing deals left and right. Even if the appraiser does a great job, the reveiw companies can't wait to chop the value.
Bad news: (December 18, 2009 9:17am)
Deregulation wasnt made to have the banks fund fraudulent loans or lend to people who couldnt qualify. They pointed the finger on the eaisest target (appraisers). Now the appraisers are brokered. The banks are at fault for doing all those exotic loans, because they wanted to package all the loans up (mortgage back securities) and sell them off. They didnt care what was going on or who they were lending to, they were making billions of dollars. Big Brother came in and just made it worse. Inforce the laws that are in place.
Wog: (December 18, 2009 9:01am)

real appraiser: (December 18, 2009 8:54am)
Oh, and all of you who are far left or far right. Both parties have screwed us all since Clinton changed bank regs and opened flood gates for allowing flipping of homes. Bush didnt help curb the bubble and massive bailouts by both parties, there is enough blame to go around. (Hell, if anyone just enforced the laws already in place, none of this would have happened) Both parties suck. They keep you guys in control by pointing fingers and hating the other party. This is how they trick you. JUST THINK ABOUT IT. The more you are engaged in hating the other party, the less you watch your own. Both parties suck, a third party with real values is needed. Almost all politicians have an agenda now, like Cuomo, first governor then president. His HVCC and all lawsuits or just to get him liked by all for the votes. Look at whats wrong with your own party, do you really agree with them, or do you just hate the other side so much you join the villagers rioting and do not see the damage being done.

sus socal appraiser: Problem is we are way too small a group (and getting smaller due to HVCC). A realtor MUST join the NAR or cannot really function. The fees for an appraiser Union only would be huge and never have serious financial clout. Last thing, someone here said that getting appraiser together or to agree on anything is like herding cats (funny, but absolutely true). Rememer every CE class you have ever taken! We need bigger numbers than just appraisers, think about it.
sus socal appraiser: (December 18, 2009 8:27am)
We do have value/power/influence in numbers, I have started to pull my limited savings & checking acct's from the "Big Banks" to my "Credit Union" accounts....If enough of us pull out from the "Big Banks" that will also send a message. We Appraisers do need to organize to have a Voice & not let the AI do our talking. No matter what happens with HVCC... we DO need to do organize.
DAG: (December 18, 2009 8:20am)
If this guy is not a nut job, maybe we do need to bail him out!
hohoho: (December 18, 2009 8:17am)
sikobitchin - thanks for bringing some reality to the surface. It is so refreshing to read facts, not conjecture. Congress/senate was crazy corrupt during the Bush years, and yes, Repubs were in charge. It is so sad for our country that people like Boehner are so highly regarded by Repubs. He should have gone down with Ney. These same corrupt men are clawing their way back to the top. If that is what the Repub party stands for, who needs it. What we have now is a bunch of them trying to do something just so they can keep their jobs next election. None of them care about the underlings who provide their paychecks. None of them are fiscally responsible. It is a lobby game. As to the shooting threat, I can only assume this person is so overcome with the powerlessness of the situation we are in as brokers and appraisers.
real appraiser: (December 18, 2009 8:16am)
The NAR only has the interest of the realtors, the NAMB has theirs, AI and others are the same. Do not get me wrong, they might help each other when things overlap. But the NAMB fought HVCC for the brokers and the NAR only cared when they saw how it affected them only after HVCC went into effect. Where was NAR prior to HVCC, they could have joined the NAMB prior to HVCC. Hell, the AI was actually helping HVCC to push designations, and they still are. If the people in these groups all joined a National Real Estate Professional Industries Group and paid small yearly fees, THAT would be some serious lobbying clout. None of the things that are happening would happen. But we all hate each other like poison, blaming each other at any chance. And we all know there is some cancer in each group. By the way this NEW group would keep the NAR, NAMB, AI and others in check. Anyone else thinks this is a good idea?

Broker In SD: (December 18, 2009 8:02am)
REO realtor is correct, sad to say. If we want to have a say, we need to show up in numbers, and NAMB is the best way to do that. As for today's commentary, I loved the "jerk" comment. You guys need to start a "J Factor" for everybody and rate them 1-10 onthe J scale Re: Appraiser's threat - It is unfortunate that this particular appraiser went to threats, which may or may not be idle, but I think it sends a message to Mr. Cuomo just how frustrated appraisers are with the situation. Nobody likes the threat of violence, but it is what some appraisers are feeling right now. There needs to be some middle ground.

Deedie: (December 18, 2009 7:22am)
Maybe we should all get together and post his bail. Maybe the media will sink their teeth in it and get the issue out to the public/consumers. This could possibly be what we needed.
James the Appraiser: (December 18, 2009 7:19am)
Well, as a Appraiser that has not had an order all month I understand why he can not ome up with his bail money, now back in 2005 it would have been no problem. I will most likely miss my Jan 1 mortgage payment and if I find some way to make that Feb is a sure miss. The bank will love it, why? They can sell my home for $325,000 in a week (worth $365,000) and my outstanding is just $197,000. So this is money in their pocket. So I expect as soon as I miss 1 payment they will be kicking me out.

I had to laugh when I saw a report yesterday when Republicans were turned away from Nancy Pelosi's "US legislative" news conference at the climate change summit in Copenhagen. You folks in Ca. sure know how to elect them.

Gee, if the appraisers bail was set at $500M and Flagstar needs $500M can we assume that Cuomo is worth $500M and let him bail out Flagstar:) These people talk about millions like I look at thousands. Anyone know where I can get a used money printing machine so I can bail myself out like the feds bail out everyone else? Let's see we will eventually the terrorist (I'm not PC deal with it) go free but make a threat and we'll never see that guy again. We need bail reform. Let's keep judges from setting bail. We need bail management companies. They will only take 50-60% of the bail as their management fee.

Oh, they do, the next day around 2pm 6 FBI agents with flack jackes and all, show up on my porch and we have an interview for about 15 min. That was a 6 months ago and I am still out in public. The Agents were nice guys, I explained the entire HVCC mess and they understood my frustration. I got the feeling that they did not care for liberials either.

Wow, if I could only 'hook' people in with a catchy Webinar name and then charge them $39 bucks to hear my sale pitch, I'd own a couple different companies too!!!
