What are the requirements on us when we are asked by the "shoppers" to provide one of those "multiple GFE's?" Do we have to provide one for every one who calls but do not complete an application? Are we obliged to take an application from every shopper?
Single Appraiser in Arizona: (December 23, 2009 6:19am)
Haven't watched the show in a while... but the 2009 Sexiest Realtors headline was just too enticing to pass up (especially for this 'younger' appraiser who frequents the Vegas pool scene in the summer quite often). Although Luba is not bad looking (probably a soft 7 in my book), I find it a mockery that the guy selection has San Francisco EMO stamped all over his picture (hide your kids)! We all run into hot realtors from time to time (it was always a topic of conversation among appraisers at my prior firm). However, I'll throw a Phoenix metropolitan realtor into the mix that made me wish I was poolside at the Rehab party or Wet Republic party in Vegas instead of appraising that house the moment I saw her: Google Lauren Ellington. Someone mentioned Texas realtors on here. I'd be willing to say they have their share of hotties, as would the upper bracket market in Southern Cal. Wonder how many realtors in San Fran were offended for not making the list? They missed out on free marketing.

I totally agree, when this delay notice was emailed around the office yesterday I was doing the happy dance, Buh bye HVCC!
SoCalApprs2: (December 22, 2009 6:05pm)
ML 2009-28 delay is a signal that HUD realizes that HVCC may be halted. Why implement a new requirement that may not be needed? HUD realizes AMC's will always be around for those who want to use them. The requirements for us Appraisers to become FHA Certified pretty much protects them. And FHA didn't do the Neg Arm Loans, so they have nothing to hide. Sit tight everyone. HVCC will soon be gone!

Leslie in Denver: You are so right about most loan agents not knowing what they are doing. I'm so tired of doing my job and having to do theirs as well. I've been in this business for 17 years, and it's amazing to me when so called "loan agents" don't know how to qualify a client. Is it really my job to tell them if their borrower qualifies...if so, then they need to get paid less and I need to get paid more. I don't mind helping them, but they are asking me to do their job constantly and have no clue about income or assets. I think a lot of the problem comes from the fact that they got started when things were simple and they basically did everything as a stated income/stated asset loan...my 10 year old could have put those loans together. I'd also love to see them actually complete an accurate 1003 and GFE/TIL...I think a lot of them are going to be hurting come 1/1/10! I mean, they don't even list all properties owned on the 1003 even when it's on the schedule e of the tax returns.

Hi concerned, You'll note we poke fun at lenders as much if not more than realtors. If your referring to comments in the blog.... we've always given a lot of latitude even if its directed at us. Truth of the matter is, most realtors and lenders quietly go about doing a good job. But whats the fun in that. Thanks a bunch

WHAT!!! Mabel didnt make the list either!!! Cmon..the sexy realtor competition is RIGGED!!
Concerned: (December 22, 2009 2:13pm)
Quick question: First of all, I find all of this bashing quite alarming considering we are all in the same industry. I guess I never knew how lenders felt about REALTORS but I thought I had a great relationship with the lenders I refer clients to. They work hard to get the deal closed and I stay in close contact with them. We both suffer through the ups and downs. I am not sure what state you are from but my company's commission is diclosed and is negotiable in order to get the deal done. Your simple question has evolved to bashing fellow members of the real estate industry. It is not easy for any of us right now and I beleive this is the time we need to support each other and stick together. I cannot say I know what you go through day in and day out so I am not about to say you are not worth the money you get paid. Please do not assume that I am not worth the money I make. Lumping all REALTORS together would be the same as lumping all lenders together. There are differences.

Hey quick question,
Did the realtor say that the 6% commision effects the APR of the loan??? If so, he is an idiot
QUICK QUESTION: (December 22, 2009 1:10pm)
I didn't argue about who makes the most money. That's the typical defense mechanism from a Realtor. They hide from the money, and then point out all the work that they think that they do. I simply asked why Realtors commission don't need to be disclosed... and pointed out that it can and does affect APR on loans. I have no problem with folks making money. It's just this attitude from some Realtors that their commission is free money that comes from thin air and doesn't cost the buyer anything is ridiculous. It is a complete slight of hand trick and we all know it. Kind of like brokers having to disclose YSP but banks don't. Banks still make the YSP on the retail side...it doesn't go away just because they aren't brokers. It's all crap and the brokers and appraisers are getting a raw deal here. Cut and dry. We all take a pay cut and the Banks and Realtors do as they please while pointing fingers at everyone else. As Dennis Miller says: But that's just my opinion...I could be wrong.
Ancient Appraiser: (December 22, 2009 12:51pm)
Love it when all we have to bitch about who makes the most money! According to MSNBC today: Sales of existing homes rose in November to the highest level in nearly three years, reflecting an extraordinary level of federal support that has pulled the housing market back from its worst downturn since the Great Depression.

Quick Question: (December 22, 2009 12:15pm)
S.Ca Realtor....You may want to re-think your "Duh" comment. This is a classic example of the lack of competence on the part of many Realtors when it comes to the financial side of the deal. That commission is baked in somewhere. If the seller didn't have to pay so much, that money could be used to pay costs for borrowers, lower the purchase price, or ultimately go back to the seller to be used as down payment money on their new house. No matter how you slice it or dice it 6% of the equity in that deal went into someone elses pocket. Not the buyers or sellers. That affects APR for the buyer by increasing costs or the purchase price, and also the seller's new loan by reducing down payment. That adds to APR. No way around it. Nice flip spin sell though...very clever rhetoric that seems to fool DC as well. Next time use something other than a Lebombo Bone to do your calculations.

As a licensed RE broker and a morgage professional the difference in a nutshell: National Association of Realtors. Appraisers so need the muscle this lobbying group, yes lobbying group has. I remember in California when the threat was on the table that dual agency would be outlawed, man you never saw NAR swing into action so friggin' fast! They want me to do their work (GFE and TIL - explain the program to the buyer, pre-qualify their borrowers), plus mine and then ask me to reduce my fee. NOT! Having been a loan officer for nearly 30 years, I can tell you most LO's today really don't know s from s and can't be bothered to learn. As for the required education? - Get a life! The test here in Colorado was more about learning the acronyms for all the Federal and State agencies whose rules you might violate and the penalties contained therein. Maybe someone should hold a class on to correctly and completely fill out a 1003, GFE and TIL, how to read a rate sheet, what are ratios, how to read a tax return, etc.

As always it's fun guys. Actually it's Realtors calming down the stressed buyer because lenders loose their stuff and ask for it over and over. Then you have the paranoid underwriter asking for a second appraisal or they didn't get the buyer's latest DNA sample. I find it amazing that the government gives incentives to lenders that can't do their job right in the first place. Let's give them loans, subsidize their over head and they still won't perform. I guess they get along well because it's the same way our elected officials function. No accountability. Just the same old dumb doodoo on another day. Rock on guys!
Leslie in Denver: (December 22, 2009 10:22am)
ATLANTA AGENT: Why would you NOT know that the property was in deplorable condition? Didn't you go and look at it with the buyers? Don't you know what is acceptable to most lenders insofar as "fixer-uppers" are concerned? Wouldn't it have been prudent to find out? As for the brother-in-law - ever heard of an Exclusive Agency agreement? If you showed the property, such an agreement would have earned you the commission regardless of who wrote the contract. CYA!! My advice.
Quick Question: (December 22, 2009 10:18am)
Hey, See the Big Picture:
I have lot's of friends that are Realtors and I am fully aware of all of that. I feel your pain. But you have to understand that LO's go through the same thing. We have 1,000 scenarios that happen every day that cause us to not get paid, and when we do, it is far less than the Realtor makes and we do about 150 pages of paperwork and have to pay an entire team of people to get the loan closed. I understand your frustration completely. But the question was...why do Realtors NOT have to disclose their commisions, and express them as APR. It is a fee associated with the deal and it contributes to the interest paid on the deal over the life of the loan. Borrowers should be able to shop that too. No way around it. Sorry if you do not agree. Happy Holidays!
Leslie in Denver: (December 22, 2009 10:17am)
Thank you, Chris! Thank you, Atlanta LO for providing a quick and easy link. I agree about the unnecessary HUD booklet using way, way too many trees. Redundancy abounds in Washington. I voted for Obama and am beginning to wonder what I was thinking! As for Realtors: they earn their money, but I agree commissions are too high based on what they do. Drive people around in their Mercedes' and Lexi? I know a lot of Realtors who simply give the buyers a list of available properties to drive by. Now that's lazy!

Hey Quick Question, what do really know about my job as a Realtor? I share commissions 50/50 with selling agents. My company takes a % of my commission. I write 1 to 72 offers (didn't you watch the video?) finally get one thru, meet numerous inspectors, all to find out the "as-is" purchase is in such bad shape that the buyer bails because the seller won't fix ANYTHING! Write on an REO & you may never hear back on your offer. Write on a short sale and you can wait 3 to 10 months for an approval. As a listing agent it can take a year or more from start to finish on a short sale, have the lender cut the commission down to 3, 4.25, 5%, evict non paying tenants, maintain deteriorating properties at your expense so they are presentable, all to get foreclosed on without the short sale ever closing? Or show a buyer EVERYTHING on the market only to have his "mortgage broker" licensee brother write the offer since he's going to kick back half the commission to the buyer. Want my job?

QUICK QUESTION: (December 22, 2009 9:29am)
Hi,
Can anyone explain to me why it is that the Realtors do not have to express the 6% they take in commissions as APR? Should they be forced to lower their fees to save the deal? Shouldn't we have the loan officer suggest that the borrower shop the Realtor constantly throughout the process so they can walk on them at any point too? Wouldn't that be real competition? If borrowers could shop agents they would save just as much or more than shopping the loan based on the fact that the average person stays in their house/loan about 5 years. Currently, Agents hold the people hostage with a contract but Loan Officers can do weeks worth of paperwork and end up not getting paid at all. I mean they are doing all of this work to protect buyers from saving $300 on the loan but nothing to even question the $24,000 that the Realtors built into the deal to line their pockets on a 400k purchase. The answer can't be that the Realtors did $24,000 worth of work...I'll take any other answer.

He said if we could get ONE person in every state to talk to their Congressman and ask them to send a letter likewise. That is what it will take. Brian and Frank, make a list of every state and see if we can get someone on here from each one to see one of their Congressmen. He said to me that he sees it all over, that this administration is putting the small and medimum businesses out of business. Only the large federal companys are going to be left standing. The REO lender requires the reinspection, as interior photos are required so cabinet doors are not in photo. It is not, per say, the appraiser needing that done but the lender. We risk saying things are completed and then the purchaser
(relying on apppraisal and in a different state, for instance, interior unseen)saying "hey there are no cabinets in here, so that appraiser owe's me for the cabinets and installation. These things, again are requied by the lenders, but most want to get on the appraiser because the lender is untouchable.

I like TBWS's HUD booklet. More to the point. I haven't heard of a single HVCC appraisal coming in at the contract price. Not one! So, send your booklet to HUD. Every freaked out Realtor ought to call HUD, too. Select your own title or escrow company? Since when? That'll be the day.

I'm surprised that Frank Didn't make the list. I mean in the bizarro universe he may be attractive ....to Realtors in SF which are by definition bizzare. I mean he's on the Dark side now? :-)

The new HUD booklet is a mere 49 pages long, only to be outdone by the FAQs but I digress. Does anyone agree, or disagree, that emailing the new settlement cost booklet as an attachment or the link to the HUD website is ok in lieu of printing the booklet? Thanks.

Your new booklet is so much on the mark. Except you really have to have the whole deal fall apart at the end because the second appraisal is an HVCC appraisal and is 50% less than the first one.
It must be tough having to fight off all those women since you're so sexy.
Old School Mortgage Banker: (December 22, 2009 5:52am)

Hey guys ... excellent piece on your adjustments to the HUD booklet. Any chance of getting this piece of today's video as a stand-alone clip to distribute to my realtor friends?
Valuequestor: (December 22, 2009 2:59am)
Sexiest Realtor???? I don't think so. Not thick enough.
MichaelWolff: (December 22, 2009 2:56am)
I think you need to make your own booklets and give copies to HUD.
Maybe explain to them that buyers almost never are able to select their 'other service providers'.
Awesome video, even I am confused!
