Hi Oooops, you should get Rate Alert & look at all the amazing options it has at tracking and anticipating the market. It's something all originators should have in their back pocket. By the way at 25 bucks per month is about 1/5 the cost of our competition.

Wish I could meet you guys in Vegas, but I'm scheduled for the Appraisal Summit & Expo there on the 10th & 11th at the Tropicana. This is the first time I've gone to one of these that wasn't in my backyard. Might as well go to Vegas while I'm still an appraiser. Jeff Schurman of TAVMA, Ron Smith -FHA, and Jim Park the Exec. Director of the Appraisal Sub-Committee are speaking along with others. I want to hear first hand what some of these ass-hats have to say. 14 Hrs. of CE, gambling and drinking. Gee......I hope I don't cause a scene! Anybody else going??

Social Appraisal Gal, I've read the California regulations for AMC's and they are extremely weak! Google the new regulations for Utah and you will see some decent requirements for AMC's to follow. (California's are the worst I've seen so far.) We plan on forming AMC legislation early next year in New Jersey and will fight for major appraiser rights in the bill! Join the American Guild of Appraisers if you're interested in appraiser independence.

Borlans-Doesn't suprise me. Some of these review appraisers are hacks sitting at some desk 1000 miles away and not at all familiar with the subject's market area. Either that or the AMC appraiser didn't know what he/she was doing either. Either way if you find either one incompetent you need to report them.

Lo; I have spoken with several banks on what their protocol will be with FHA's after 1/10/2010. Some don't know yet, some are odering assignments themselves and most are using AMC's along with their conventional loans. You are correct that FHA isn't requiring the use of an AMC; however, nobody or nothing is requiring the ue of an AMC now for any apprasial assignment for any reason. The banks have always had an option which is why many FHA's assignments will be handled differently just like the conventional assignments. It's also why AMC's aren't going away even if HVCC does, HVCC just greased the wheel.

Toby - FHA is not risk based pricing, and fha does not have a credit score. THe credit score on FHA being imposed by lenders has to do with their servicing set aside for bad debt. The lower credit scores they have the more they have to set aside. So to avoid the set aside, the score was imposed.

GOback to brokers picking the appraiser and then the bank can do a review. If it comes in 10% difference then a 2nd review to go over rebutals. WHo ever is wrong, they go up in front aof a board. If they can not back up their value, first time slap/fine 2nd time pull their lic. everyone wins. Banks are protected, brokers get their appraiser and they weed out the bad ones.

You guys sound like a couple of bitchy little girls today. FHA is NOT risk based pricing. Say it again. FHA is NOT risk based pricing. Take it up with your congressman.

In all honesty, I have reached the point were all things considered, it is what it is. My efforts and over the past 20 years have been literally stolen. Compounding this reality is the fact that I have been paying the thief with my hard earned tax dollars. The HVCC has not only robbed me of a substantial and ever growing segment of my appraisal business, but even more importantly, has robbed me of the right to rebuild it. I also sense that the powers that be literally do not give a rat's arse, as they have become so accustomed to screwing up money, lives and systems with total impunity. Unfortunately, "We the people", have about as much power as power allows us to have. And, the power of we the people has become infected with the interest of the few at the expense many. So, while while I hope that this works out for the benefit of the many hardworking, honest and optimistic Appraisers, mortgage and real estate professionals like myself, I am becoming doubtful that will be the case.

Mark-This is why I say the BANKS should be paying the AMC fees not the consumer/appraiser. The appraiser fee should not be involved in the transaction whatsoever. The appraiser should be able to collect at the door and the banks should pay the AMC fees being that the banks are the ones technically using the AMC service to find and order appraisals. Why do the consumers/appraisers have to pay for a service that the banks demand be used?
HVCCISKILLINGME: (December 02, 2009 9:47am)

Ho about the old system with a review. lenders get a good appriaser banks are protected by the review. If the appraisal/review is off by say 10% then it goes to a second review and see who is off and then that person goes up in front of a board where they can prove how and why the value. If the that can not first time slap 2nd time take their lic. away. weeds out the bad appraisers/reviewer.
Mark: (December 02, 2009 9:34am)
HVCC - I still view this as a violation of RESPA. Teh appraisal fee shown on the HUD should be the fee to the appraiser. Since the AMC is not paying that fee to the appraiser are they not "marking up" the fee?? Violation of RESPA. Also, HVCC was to allow portability of the report amongst lenders. Since no Lender will accept and "portable" appraisal, are they not in violation of the "code"?? Who do we contact to report HVCC violations by Lenders/Banks???

Mortgae & Real Estate Guy - I'm all for full disclosure. Banks do not have to disclose YSP or in their terms SRP. Brokers do. Full disclosure would be having the BANKS disclose thier income - SRP. The bank can still show the 2000 but they are still getting SRP netting them more income on top of the AMC fees they are raking in. Never though of the tax part - wonder how long it will take the IRS to close up

Frank & Brian or anyone else who may know the answer-Just a suggestion/thought. Why aren't the banks paying the AMC fees instead of appraisers when tecnically the banks are the ones utilizing the AMC's services not the appraisers? If we can't get the HVCC reversed I would like to see at least that. Then let the AMC's have to wait for their payments and let us appraisers collect at the door. Again, just a suggestion. Would prefer the HVCC to go away but I have lost hope of that happening....

Mortgage & Real Estate Guy: (December 02, 2009 8:33am)
I have been crediting the YSP for almost 10 years now. Take advantage of the tax loopholes we have available. The borrower is looking at adding $3000 to $8000 to their loan amount. Charging higher points and crediting them the YSP is a great selling point. Because it helps them further their economic goals. MARK: in regards to your bank loan officer (that most likely won't have to credit the YSP). If you are a BROKER, they can't compete with you any way. If the BANK loan officer charges $2000 Orig. and makes 1% YSP. His/Her interest rate will be .25% to .50% higher than yours to make the same YSP. If in fact the YSP has to be credited, I haven't heard solid evidence in either direction yet. It will only help the borrower and you can make the same amount of money. Plus it helps the perception of FULL DISCLOSURE!!!

hey frank,
i thought you should know i called Barney Franks office yesterday and actually spoke to a guy that said Barney Frank is against the HVCC. I then asked if he is against it, why isnt HR 3044 being let out of comittee? He gave me some BS answer that all the financial changes will be rolled up into 1 bill for everybody to vote on rather than 1 bill at a time. basicaally he is just holding the bill ransom. I think we should get more people to call his office to put pressure on him to get that bill out to a vote.

James the Appraiser furthermore what makes you think the HVCC is going away. As Frank and Brain found out in New York...its not going away they want us to re write it...I too would love to see it go away but I don't see that happening as too many in the banking world are getting money out of this one and they are in bed with the law makers...Don't get me wrong...I would love the HVCC to go away I am just being realistic...
Mortgage & Real Estate Guy: (December 02, 2009 8:26am)
MARK, especially MARK: You need to recalculate your math. If you charge $2000 Origination, and credit your 1% YSP. You still make $2000. Crediting your YSP does not reduce the amount of your Origination. Furthermore, you should charge your YSP on the front end anyway, and the credit the same amount back to the borrower. WHY YOU ASK? For tax reasons, the borrower can only write-off POINTS. Example: 1% Orig, 1.5% YSP. Why whould you make 2.5% points on a loan and only let the borrower get a tax deduction of 1%. If you charge 2.5% Origination. And Credit the 1.5% YSP. You make exactly the same amount of money, but now the borrower get a tax deduction of 2.5%. This is something every loan officer in the country should do for every client. This is a great selling point for borrowers that are on the fence. You will have to practice how you educate your clients because some will not comprehend what you are doing. Spend the time to educate the client, they will come back to you
Socal Appraisal Gal: (December 02, 2009 8:24am)
In reference to James the Appraiser...I guess you don't get it...Call the OREA they are going thru applications right now and you have to be approved with the state. They are taking notes from us all and not approving the ones who violate USPAP or are conducting themselves in an unethical way. Don't kill the messenger. This is a step in the right direction and I am exposing the bad AMC's so they don't get approved. These would also be AMC's that are not paying you..They are trying to put a stop and regulate them. Ps I know they are overloaded but they are hiring. I send in bad appraisal reports and they do eventually get to them. Believe me there are two appraisers in Ca that don't have lic. anymore thanks to the information I was able to provide to them over the years. But yes they are back logged and it takes time. They get frustrated to as they put together a good case and the DA ends up dropping the ball and slapping a hand rather ENFORCING the law to its fullest.
DAG: (December 02, 2009 8:22am)
Mark, I signed on that webinar yesterday, but had no audio. When are the guys in Washington going to get educated on our business? Are they really that uninformed that they believe only brokers make any money on a transaction? It is so frustrating when I have banks in my region who promise only $250 in closing costs or to refinance for only $250 and business pours in to them when their interest rate is higher than I offer and they do not disclose that all the fees are not included in $250. The borrower always shows up to close and it costs more. And who could not refinance for $250 when you are not promising any rate at a future date. I make it a point to tell all my borrowers the banks are making money they do not need to disclose.

Hey Frank, do what have you guys heard / foreseen these new HUD/GFE restrictions impacting us brokers. We get other LO's telling us all the time that brokers are basically going the way of the Dodo. Do you see lenders significantly changing or altering their process to approve brokers because of the FHA guideline changes? We've been brokering FHA loans for 8 years and haven't had any issues, so we're wondering if Lenders will start restricting which current brokers they work with. Thanks for all the work you guys do for us - Curtis

Hello All - as a California Appraiser I'm not holding my breath on the OREA keeping an eye on the AMCs. They don't have the man power to over see appraisers at this point. Over teh past 3 years both my father and I have sent in reports that needed to have the appraisers license taken away and fines as part of the problem, but they have not even started the research on the first of them. Three years, by the time they get to slapping the hand of any of he AMCs we will be in full recovery and HVCC and the AMCs will all be gone
Nor Cal Mortgage Broker: (December 02, 2009 7:38am)
FHA went wrong when the loan limits went up to the conforming limit amounts. Back in the day, when they were low, it made sense to include assistance because only low income people were getting them and 3% of $125K isn't really a market value mover, but 3% of $400K is. Look at USDA loans - great performance ratio overall despite no down & low FICO requirements because the income limits keep the loans to the people who need them. If a buyer can afford to make a payment on $400K, then they should be able to save at least 5% down while they are paying rent or they have a serious money management issue that will surface when they own.

Charlie O - I was just in a webinar with NAMB and there was a Vicki Bott Deputy Asst Sec of Single Family Housing in attendance. When reviewing the GFE page 2, when it involves a BROKER ONLY, any YSP must be credited to the buyers thus our income is reduced. In order to make YSP, we have to inflate the origination. On a 100,000 mtg if you wanted to make 1 and 1 for a total of $2000 the origination has to show $3000 and then a $1000 credit with a net of $2000. Banks can show $3000 and still get the $1000 on the back and make $4000 when we can only get $2000. UNFAIR BUSINESS

Yes there are many changes happening on the 1st of Jan. The state of California is making it mandatory that AMC's are approved with them. So if anyone would like to report the wrong doings of certain AMC's that are more concerned with turn time for the cheapest price and usuing unqualified outside of the area appraisers while sticking a big bill with the client in which they keep they keep all the profit call the OREA of CA or go on their website and expose them. Not allowing the unethical AMC's to work in the State of California is a step in the right direction. I have been told there are other states doing this as well so call your states Office of Real Estate Appraisers and if their not suggest they follow in the footsteps of California and regulate the AMC's. This is one way that we can be pro-active and cause force positive change in the HVCC...gee regulate the AMC's brillant!!
RobG2CCG: (December 02, 2009 7:01am)
The problem with Seller funded DPA's had nothing to do with LTVs, credit-worthiness, class-association, loose mtg guidelines or transparency. They were a problem because they masked the true value of the home. Instead of lowering the sales price, sellers were paying for the buyer's closing costs. If the seller was not permitted to do so, then the sales price would have been lowered.
The issue of helping folks with DP funds needs to be separated from the sales price of the home (like with the tax refund pgm, and local grant money). Only then can we determine whether or not 'skin in the transaction' is a real determinate.

A little note on branding...Don't change things that work...Every day I relied on the intro music with the announcement, 'Morning..It's time for your TBWS Daily'...I made a game out of it by asking my wife about the time I clicked on the video link, casually, what time is it?..(w/variations such as about what time you recon it is?)For over a month, I got her to reply with the time just about when the intro music come blaring out...(She will no longer tell me the time, even when I seriously need to know the time.) Any way... I forgave you the intro music while you guys were in New York, but now you've proceeded to throw a lame intro on us. Do us (and yourselves) a favor and put the intro music back where it belongs, and not muted somewhere behind Frank's beady eyes. Keep up the killer content though, us Brokers rely on it. (Yes, I'm a broker....or as I like to say of recent...I'm a broker than I've ever been) Thanks

In Newsday a Long Island paper, they are laying off 600 people today in there Meville Operations home office. They are searching for lenders to take over there pipelines. HUD plans on not filing criminal charges. My question, WHY NOT?

Here's one for the books!!BOA took monies out of our account that did not belong to them nor did they have our authorization.Nor do we bank with them. This was because our tenant told them the ck from April was frauduluent. We have been to the D.A. and were told that the fraud was committed by tenant to BOA and that we only have recourse against BOA through the courts. If this is the case than I want all my mortgage payments made to BOA back since they frauded the US consumer for 55 billion!!I have filed with the Federal reserve, the FTC, Postal Inspector, our Congressman and Senator and notified the Media who may be interested in carrying this one. I went to a branch next to our office and they refused to give us any info or cooperate. I also filed with Ken Lewis Corporate office at BOA. If anyone needs these numbers just email me.It's no the amount it's the indignant attitude that they can do anything.
