James..believe me..they are just calling another appraiser in and blowing smoke up your butt..check again in 45 days ..it will be closed in the MLS with the agents you saw on the day of the inspection..I am not sure those instructions were meant for that type of above the norm of construction or if they meant call us if you get there and its an igloo in Alabama though
James the Appraiser: (April 20, 2010 3:33pm)
Had an appraisal order last week with 10 pages of Lender Instructions, no lie. The home was steel post and I-Beam. Lender instructions required me to STOP if the home was A-typical in construction, tell the lender what I found and wait for the lender to let me know if I should complete the report or if they wanted to cencel. I did just as the lender asked in his 10 pages. The AGENTS went nuts and even contacted the lender by phone. No need to say more, the lender was happy I followed the 10 pages and were so upset with the AGENTS that they canceled the report. They told me thank you and they would send me a check for my trip out to the property, but that due to the AGENTS reactions they were no longer interested in making the loan. So the AGENTS FU$$$$KED you the deal for the buyer and seller and the appraiser walked away clear with money in his pocket. This may be a first this year, yes - no?

I had to have a back ground check and pay for it to join one AMC. Only received 3 orders since last May. We are not able to pick up our fee at the door as per HVCC. AMC's pick our pocket for 1/2 fee or more, for sending e-mails. I on the other hand spend tons on money just keeping a license, expenses and hours of hard work to come up with a estimated value. I don't need an "egg management fee". Even a child knows whos stealing from them. I can market myself like in a real free market. I earned the license for myself not for the AMC's.

they don't want to deal with it because they don't know how to deal with it. that is one of the many reasons the banks are getting away with the b.s. as they will deal with it. this is why it is imperative that we have a voice on the federal level to push back and represent our interest. love it or hate it, lobbying is effective and affective. remember there is no punishmnet for going outside hvcc, it's basically a rouse that is imperative and illegal. i just wish there were banks or a bank that would jump out and operate the old fashioned way within firrea guidelines. nobody would get in trouble, i'm really surprised that the 'ol boys club on the street hasn't figured that one out. if fha don't care why should we ?

It also occurred to me that since the banks were shorting the CDO's they were creating because they didn't believe their own bs about home values going up forever, What if... I mean, What if, the banks were flush with cash from shorting and pleaded destitution only from their long positions? And then threatened bankruptcy to scare everyone into bailing out their bad plays and all the while keeping hush hush their winning short plays? We can't audit their books so we don't know - we're taking their word for it ON EVERYTHING! Fed and Treasury made that deal, no audits. If they can put everyone in the world into debt with liar loans and no doc loans and all the while selling worthless CDO's rated as AAA by the ratings companies THEY paid off-can we really put it beyond them to scam us every and any way they can? Including pleading a fake bankruptcy? Maybe Lehmans was legitimately bankrupt, or maybe they were a pawn in this chess game. TARP was meant to buy bad assets, not for bail outs.

I spent close to an hour to. Then I realize instead of wasting more time ask for help. Which you did a better job than myself in doing. The appraisers are not the only whores for the banks. The federal government is bending over forward for the banks by taking lobbist money. The government has no interest in the little guy. They are just covering their butts and that is all they care about. The response FHA gave is a joke and it proves to me that the government does not give a crap about you or me. If they did they would fire the head of the FHA. But no he still has his job and have sold all of us down the river to the AMCs.

I just spent over an hour looking for those 7 questions on www.regulations.gov and couldn't find them. I called regulations.gov and they couldn't find them so I called the Treasury & the White House. All told, about 7 calls. Treasury just referred me to the White House and that was a dead end 2 times. 3rd time someone suggested I search WhiteHouse.gov. It's not there and no one seems to know where the questions are. The best suggestion I heard is that they're not posted yet and to search back at regulations.gov. So, there we are. Along with the consumer protection agency called the IVPI (Imaginary Valuation Protection Agency) we have an imaginary request by the White House for public input on housing finance reform. I'll keep my eyes open and post a link if it ever shows at regulations.gov and check the White House site. You can submit comments at WhiteHouse.gov if that's any consolation. I was told Obama reads 10 e-mails a day so if You're lucky he might read yours. It's worth a shot.

No more having to round up your own business, getting paid before the report is finished, having no contact with loan officers or anybody that could have any problem with your way to conservative value. Just log on to a website or two and get free business. Meanwhile the end user (borrower) is getting jacked for an extra $150.00 per report. Loans are getting denied becuase some appraisers adjustments suck and the borrower can't transfer the overpriced report!!!!!

Antique appraiser
southlandappraisersunion.com tell me your story I will spread it around.
AND one note to the realtor that was made because his deal did not work, and blamed it on the appraiser coming from another place. It may have happened because you had a bad appraiser but distance has nothing to do with it. EITHER you believe in theory of appraisal or you do not. I could parachute into Australia and do a good appraisal it would simply take longer. Tell me this, in Australia on main street 3 sales are from 100 to 120k and they are all very similar to your subject , would that alone not indicated the value would be very likely depending on time and immediate market changes, but likely be between 100k and 125k ???
REALTOR YOU ARE OPENING A CAN OF WORMS THAT WILL BITE YOUR RUMP. DO YOU WANT TO LIMITED BY DISTANCE ON YOUR LISTING. BECAUSE HOW CAN YOU LIST IT AND SAY AN APPRAISER CAN NOT APPRAISE IT. I have been appraising since mid 80"s, it was not even a profession then.
objective1: (April 20, 2010 10:32am)
Once they get the appraisal report. That's it.
Everything else is extra. Time is money. No free lunches, etc.
Unless a proven error or oversight is presented all addendums and reassurance letters come at a
price as well as rebuttals. If the client or realtor doesn't agree with the reviewer, let them deal with the reviewer as he is the one who created the new value. The appraiser is supposed to be an independent third party not an advocate for the selling agent or the borrower nor is he obligated to "sell" his value. The buyer or agent has the option to sue the parties who wrongly negate the deal and well they should as this approach worked well in mid 1980s. Your attorney knows what to do. It made believers out of those who arbitrarily prevented a legitimate transaction to close. It hits home when they are in court. And other lenders pick up on this in short order. You have to stand your ground or suffer.

There are hookers and there are panderers,
but some of you appraisers are assuming the roles
of both.
There would be no problem with AMCs if some of you would have the intestinal fortitude to just say NO.
I have been in the business long enough to remember when AMC type services were referred to as "sweat shops" and only the lowliest of the low would stoop to even speak with the exploiters.
The average appraiser had a higher sense of professional pride then. Obviously the AMCs are now aware that there are many out there who don't.

Look-report this immediately to the State. The State should instruct the AG to investigate. The appraiser should also be concerned as its his/her signature and license#,S/He is responsible for their signature. That licensee should be aware that the State will put them through the mill for this problem and they will probably get sanctioned by the State if there is a problem on the report or review. This is a major problem with PDF format as the signatures may be be taken off the report as they are a separate pdf.

Remember the State licensing board doesnt believe is hearsay or telephone conversations. They want written proof,so document proof in your report and file.If the client wants something out of the"ordinary"in a report, document as to why its included in your report. If the client has no problem with demanding that particular inclusion, they should have no problem about you documenting it in your report as a specific condition of your commission. If they have a problem with documentation,be concerned,as its your license they are putting on the line not theirs.

Had 1st really bad experience with HVCC. purchase, value came in low, no problem. Went for review to an appraiser 400 miles away, cuts value another $50K, we request rebuttal, returned in 1 hr, weird n weak. Selling agent calls appraiser to discuss additional comps, find out appraiser didnt know anything about value cut or rebuttal, but his name was signed to it. Reviewer has no knowledge of area reviewing n people signing on behalf of the appraiser. Isn't this solidly against HVCC??? Or is pulling in appraisers with no knowledge of the area appraised OK, and signing on behalf of an appraiser acceptable practice. Wonder if fraud is worse than ever with HVCC????
Joecolorado: (April 20, 2010 7:27am)
HAPPY DAYS-The overlay may be acceptable, but make sure that the"investor overlay"is recorded in your document as a client specific exclusion, with a reservation that the FHA appraial is dependent on FHA accepting that particular exclusion. That way FHA can decide whether to insure that particular property with that overlay condition and you are covered as you have informed all of the parties of the exclusion.Dont just insert the overlay because the client"wants"it,but explain why the overlay is included in your report. If there is a question from the U/Writer,then document it in your file and answer the question as a condition and an inclusion of and in your report.

Everyday I read appraisers complaining about AMC's and their low fees. The low fees seem to be the biggest complaint, well, DON'T WORK FOR THEM, its pretty simple. If you don't work for them and if you help by spreading the word to other appraisers in your market area AMC's will eventually pay more or fold. I have AMC's calling me to ask if I will do an assignment and when they tell me they will pay me $175.00 I say sorry but I cant help you. I will find another line of work if I have to before I lower myself to work at scab wages. Nobody out there is going to help you so you will have to help yourself by NOT ACCEPTING ASSIGNMENTS from AMC's.

The other problem with HUD and Lenders is . HUD can make a rule but the Lenders can change it. (overlays) how many banks are making there own rules. This maybe why HUD does not want to get involved. I pleaded with two banks to call HUD on a guideline and they would not. They just said investor overlay. Even banks that say no overlays had overlays. When asked about that, they said it was not theirs it was the investors. HUH?????????

I agree with makeithappen, Appraisers need to grow some and refuse the work. You just filed your taxes, right? Are you REALLY making any money? Or, is it money in money out and it "Looks" like you are "feeding the family"?
Are you PAYING taxes? I betcha you didn't... right?
There is Appraiser work beyond lender work, and they DO pay reasonable on customary fees. But, you have to have some credentials to get that kind of work. You can't just fill out a form and throw 3 comps on a grid. So get busy Appraisers, learn how to do our jobs right, or get out.
Lets make Appraising a PROFESSION again. Form fillers please go find another job.

makeithappen-certified for 12 years - used to make almost a 3 figure income - after hvcc it literally disappeared - I put all my customary fees on 8 amc's got NO work - after 4 months - contacted one of them - in my area the AVERAGE was 240 - lowered my fees to 275 a few trickled in - have 1 kid in college and one at home - been on unemployment since July, savings is gone - AMCs hold me responsible for errors they make when sending the order and don't send work for that reason - everything they expect is so a computer can review it - and they don't want licenses or resumes so homeowners/lenders can't see the level of experience or lack thereof that the appraisers who are working do/don't have - an old client has sent me some to look at to see if they are credible - the guys can't even spell But they are working. So don't give us crap about balls;the govt system doesn't care and computers don't either. I vote - I contact my reps - and I do great appraisal work--or used to

If appraisers nationwide would not accept these low fee appraisal orders, then the fees would take care of themselves...but I know we will have the whimps that say,"I have to feed my family." Well we all have to feed our families!! I am a certified appraiser in Dallas/Fort Worth and I do not accept any order below $300 and turn most of them down. Has to be a really easy one for me to accept.
Appraisers, grow a pair and this rubbish will stop but we have to do it ourselves and quit crying.

Didn't know where to put this, so figured I'd submit here.
Let's start picking on HAFA a bit. Same ole government shenanigans.
